The purpose of the district is to provide increased opportunities to use and expand existing structures and construct new buildings in convenient and appropriate locations in the R-1 areas of Town to provide medical services to the residents of Federalsburg and surrounding areas.
A building or land shall be used only for the following purposes and in all cases be subject to site plan review and approval.
A. 
Any use permitted in the R-1 Single-Family Residential District.
B. 
Medical services, including professional medical offices, clinics, and similar treatment facilities.
Medical offices and clinics may be approved by the Planning and Zoning Commission, based on appropriate review and approval of the requisite site plan, as the first step in moving the subject parcel through the Zoning Map amendment process for floating zone designation in the R-1 District. In general a medical services Zoning Map amendment is contemplated in single-family residential areas where buildings and lots of suitable, size, location, and character exist. The uses and structures proposed are to be planned and developed according to the requirements and procedures of this chapter. Medical services shall be approximately located with respect to providing for the general convenience of area residents while respecting the pattern of urban development existing or proposed, and to existing public and private facilities and services in such a manner as to blend harmoniously, provide desirable convenience to residents, and minimize disruptive traffic and parking impacts on the residential neighborhoods in which they are located.
A. 
Preliminary approval. Application for preliminary approval shall be made to the Planning and Zoning Commission. The Planning and Zoning Commission shall review the site plan for compliance with the requirements of this chapter and the Federalsburg comprehensive plan. Before recommending approval of a site plan, the Planning and Zoning Commission may make reasonable additional requirements including, but not limited to, utilities, drainage, landscaping and maintenance thereof, lighting, signs and advertising devices, screening, accessways, curb cuts, traffic control, height of buildings and setback of buildings, to protect adjoining residentially zoned lots or other uses. The site plan shall be amended in accordance with the requirements of the Planning and Zoning Commission before receiving the final approval of the Planning and Zoning Commission. Information submitted for preliminary approval of the medical service use shall include, but not be limited to, a preliminary site plan (seven copies) which includes:
(1) 
A general diagram showing the facility's relation to the Town of Federalsburg and major public access to the site including orientation of the parcel at a scale and size considered appropriate for adequate understanding and review by the Planning and Zoning Commission (as it may determine).
(2) 
Lot size and the location of existing and proposed structures, off-street parking, and yard.
(3) 
List the exact name and address of the legal titleholder or titleholders and give the appropriate references to the deeds conveying said property.
(4) 
Contain a written assent to the petition signed by the legal titleholder or titleholders.
(5) 
A metes and bounds description of the property covered by the petition.
(6) 
Proposed limits (boundaries) of the application for the MS-1 Floating Zone designation.
(7) 
The general location and character of construction of proposed streets, alleys, driveways, curb cuts, entrances and exits, parking and loading areas (including number of parking and loading spaces), outdoor lighting systems, storm drainage and sanitary facilities.
(8) 
General location, height, and material of all fences, walls, screen planting, and landscaping and management thereof.
(9) 
General location, character, size, height and orientation of proposed signs, and management thereof.
(10) 
A written and mapped statement indicating the current zoning of the lot in question, as well as the area immediately adjacent to the site proposed for designation of the MS-1 Floating Zone.
(11) 
These information requirements shall be provided to the applicant by the Town Clerk prior to submission of the necessary diagram and supporting documentation to the Town office. The Town Clerk shall check the submission for completeness and when complete place on the next regularly scheduled Planning and Zoning Commission agenda.
B. 
Planning and Zoning Commission approval. The Planning and Zoning Commission may approve the preliminary site plan or require changes and/or conditions for approval or may deny the application for cause based on findings of fact that will be read into the record and also provided in writing to the applicant.
(1) 
An approved preliminary site plan shall become a final site plan.
(2) 
A final site plan shall accompany the Planning and Zoning Commission's favorable recommendation to the Mayor and Council for a Zoning Map amendment to locate the "application" of the Medical Services Floating Zone.
C. 
Public hearing. The Mayor and Council shall hold a public hearing on the request for a Zoning Map amendment to apply the MS-1 Floating Zone designation after the Planning and Zoning Commission has approved a site plan for the proposal. The site plan shall not be the subject of the public hearing but may be referred to for clarification concerning the specific nature of the development plan contemplated for the parcel. This chapter predeems the uses contemplated to be compatible with the policies contained in the Federalsburg Comprehensive Plan subject to the specific review and analysis of the Planning and Zoning Commission for application to parcels in accordance with the requirements and stipulations of this chapter.
A. 
Utility buildings of 150 square feet or less shall be permitted as accessory structures in the side or rear yards. See § 245-113F and G.
B. 
Garage, private. See § 245-113F.
C. 
Home occupations. See § 245-6, Definitions.
D. 
Accessory off-street parking, open or enclosed space, for one commercial vehicle of not more than one-ton capacity and used by the occupant of a dwelling shall be permitted as an accessory use.
