Functional departments of the municipal organization shall be created or abolished by the Mayor and Council as provided by the Charter or other applicable law. Within these departments, the organization of specific functions shall be the responsibility of each department manager, subject to the approval of the City Administrator. The highest ranking employee of each department shall be designated the "manager."
The City Administrator shall be the chief administrative officer of the municipality. He shall be subject to appointment and removal by the Mayor and Council. During the tenure of his appointment, he shall possess and exercise the powers and duties prescribed by the Charter.
A. 
The City Administrator, department managers and designated employees in charge of staff functions under the City Administrator shall comprise the administrative staff of the municipality.
B. 
The administrative staff shall serve under the direction of the City Administrator and shall advise and consult with him upon all matters affecting the welfare of the municipality or relating to any phase of the municipal administration.
C. 
The administrative staff shall deal with the Mayor and Council through the City Administrator, except in response to routine inquiries or in connection with investigation under § 603 of the Charter. Employees in the various departments, except in response to routine inquiries or in connection with investigation under § 603 of the Charter, shall deal with the Mayor and Council only through their department managers and the City Administrator.
A. 
Managers of departments of the municipality shall be appointed by the City Administrator, with the advice and consent of the Mayor and Council, solely on the basis of executive, administrative and technical qualifications appropriate to the duties of each department.
B. 
A member of the administrative staff may serve as manager of more than one department.
C. 
Managers of departments may be removed by the City Administrator with the advice and consent of the Mayor and Council.
D. 
Each department manager shall:
(1) 
Cooperate with other departments in furnishing them such service, labor and material as may be requested by the manager of such other department, subject to such regulations as the City Administrator may prescribe.
(2) 
Manage and supervise the activities and personnel of his department, establish objectives and standards for the performance of work and administer the operations of the department in an efficient manner for the effective providing of services.
(3) 
Develop and recommend an annual budget and program plan for his department, approve and control the expenditure of funds within the department's approved budget and report to the City Administrator on the operations and activities of the department.
(4) 
Consult with and advise the City Administrator on the operation of the municipality as it relates to his department and perform such other duties, activities and functions as the City Administrator may direct.
Section 804 of the Municipal Charter of Hagerstown provides that the City Administrator and all department managers shall be designated as unclassified employees. As such, the City Administrator and all department managers shall not be subject to the merit system as authorized by § 803 of the Charter and shall not be entitled to the protections, procedures and grievance rights detailed in the City's Personnel Manual.
The City shall have the following departments, with the functions, duties and responsibilities hereinafter described for each department. The City Administrator shall have the authority to assign temporarily duties and responsibilities among such departments.
A. 
Fire Department. The Fire Department shall be responsible for all activities related to fire suppression, fire inspection and prevention, including the enforcement of the Fire Prevention Code, and maintenance of fire apparatus and facilities. The Department also serves as a liaison to the volunteer fire companies.
B. 
Police Department. The Police Department shall be responsible for all activities related to the prevention and suppression of crime, apprehension of violators of the law, protection of life and property, and traffic and pedestrian safety.
C. 
Department of Finance. The Department of Finance shall be responsible for all activities related to the management of and accounting for municipal funds, including disbursements, collections, investment of funds, the accurate reporting of the municipality's finances and supervision of personnel engaged in accounting, tax collection, utility collections, data processing and parking fund collections.
D. 
Department of City Clerk. The City Clerk shall be responsible for maintaining accurate minutes of Mayor and Council meetings and maintaining all official documents.
E. 
Department of Human Resources. The Department of Human Resources shall be responsible for various personnel functions, including recruitment and staffing, selection, employee development and training, employee assistance programs, benefits consulting, labor relations and administration of grievance and disciplinary procedures.

F. 
Purchasing Department. The Department of Purchasing shall be responsible for monitoring and reviewing all City purchases for Code and policy conformity and maintaining inventories for the general stores stockroom.
G. 
Special Projects Department. The Department of Special Projects shall be responsible for the City's insurance, risk management, safety and enterprise zone programs.
H. 
Planning Department. The Department of Planning shall be responsible for site plan review, coordination of annexation procedures, historic preservation, Comprehensive Plan update and administration of the Zoning and Subdivision Ordinances.[1]

I. 
Community Development Department. The Department of Community Development shall be responsible for managing the City's rehabilitation loan program, coordinating the use of Federal Community Development Block Grant funds and administering other Housing and Urban Development (HUD) related programs.
J. 
Department of Engineering. The Department of Engineering shall be responsible for coordinating and inspecting construction contracts, providing design services to City departments and enforcing City ordinances, including issuing permits for building, plumbing, electrical, grading and curb and sidewalk construction.
K. 
Department of Public Works. The Department of Public Works shall be responsible for maintaining City streets, vehicles and equipment, buildings, traffic signals, signs and parks and recreation facilities.

L. 
Light Department. The Light Department shall be responsible for providing purchased power through an electric transmission and distribution system.
M. 
Water and Sewer Department. The Water and Sewer Department shall be responsible for all aspects of sewage collection, treatment and disposal.
N. 
Water and Sewer Department. The Water and Sewer Department shall be responsible for coordinating all activities of the public water system, including treatment, pumping and distribution.
O. 
Department of Recreation. The Department of Recreation shall be responsible for the operation and management of all City recreation facilities including Potterfield Pool, the Municipal Golf Course, the Jonathan Hager House, the Fairgrounds and any future or similar facilities, and all City recreational programs including summer youth camps, and other recreational programs.

The City Administrator may, within the budget appropriations approved by the Mayor and Council, create such administrative staff offices as may be required to administer the operations and affairs of the municipality.
