As used in this article, the following terms shall have the meanings indicated:
OPEN AIR MARKET SITE
Any location within the corporate limits of Princess Anne on which an open air market vendor is conducting business, but shall not include yard or garage sales conducted by an individual on his or her own property.
OPEN AIR MARKET VENDOR
Any person, business or legal entity conducting a temporary business for the purpose of selling goods, wares, commodities, foodstuffs, merchandise or products on property located within the corporate limits of Princess Anne, whether or not from a motor vehicle, and not located within a permanent structure, but shall not include charities and nonprofit organizations, including but not limited to Old Princess Anne Days.
All open air market vendors shall obtain a permit in accordance with the provisions hereof prior to conducting business in the Town of Princess Anne.
A. 
The fee for such license shall be as set by the President and Commissioners from time to time, and the permit shall be issued for no longer than a period of one year from the date of issuance.[1]

B. 
For those vendors providing proof that they are 62 years of age or older, the cost for obtaining a permit shall be 1/2 the cost provided above.[2]

C. 
The Town Manager shall, within three days of receipt of the request for a permit, grant or refuse to grant such permit.
D. 
The vendor shall be required to keep the permit in a conspicuous place at his or her site.
Each site shall conform to the following requirements:
A. 
The maximum size shall be 10 feet in width and 25 feet in depth.
B. 
No site shall be closer then 10 feet to the neighboring property line, except that if the neighboring property is a residence, then the setback shall be 25 feet, and no site shall be closer than 25 feet to the nearest street, alley or road.
C. 
The vendor shall be responsible for removing all trash at his or her site. Trash containers are encouraged.
D. 
Items offered for sale shall be displayed on tables, unless the height of the item renders such display inappropriate.

A violation of the article shall be declared to be a municipal infraction and shall be subject to a penalty as provided in Chapter 1, General Provisions, § 1-8 of this Code. In addition, as a penalty pursuant to this section, a vendor's license may be revoked until such time as the fine is paid.
