As used in this chapter, the following terms shall have the meanings
indicated:
GARBAGE
Decayable animal and vegetable wastes resulting from the handling,
preparation, cooking and consumption of food.
LITTER
Includes "garbage," "refuse" and "rubbish," as hereinafter defined,
and all other waste matter which, if thrown or deposited as herein prohibited,
tends to create a danger to public health, safety and welfare.
PARK
A park, square, playground, beach, recreation center or other public
area in the city, owned or used by the city and devoted to recreation.
PRIVATE PREMISES
Any dwelling, house, building or other structure or parking lot designed
or used either wholly or in part for private residential, industrial or commercial
purposes, whether inhabited or temporarily or continuously uninhabited or
vacant, including any yard, grounds, walk, driveway, porch steps, vestibule
or mailbox belonging or appurtenant to such dwelling, house, building or other
structure.
PUBLIC PLACE
All streets, sidewalks, boulevards, alleys or other public ways and
all public parks, squares, spaces, grounds and buildings.
PUBLIC RECEPTACLE
A receptacle placed by the city at various locations for the reception
of litter, other than household or commercial refuse.
REFUSE
All wastes, putrescible and nonputrescible, and body wastes.

RUBBISH
Nonputrescible solid wastes consisting of both combustible and noncombustible
wastes, including paper, wrappings, cardboard, tin cans, yard clippings, wood,
glass, bedding, crockery and similar materials.
No person shall within the confines of the City of Corning:
A. Place or deposit litter in or upon any street, sidewalk
or any other public place, except in public receptacles and/or in private
receptacles in the alley at the rear of buildings, except on trash pickup
days, and in such a manner as to prevent the litter from being scattered or
carried by the elements.
B. Sweep into or deposit or cause to be swept or deposited
in any gutter, street or other public place accumulation of litter from any
building, lot or from any public or private sidewalk or driveway.
C. Throw or deposit litter upon any street or other public
place or private premises from a vehicle; nor operate a truck or other vehicle
unless the same is so controlled so as to prevent its contents from falling,
being blown or deposited upon any street, other public place or private premises.
D. Throw or deposit litter in any park, except in public
receptacles and in such a manner as to prevent such litter from being scattered
or carried by the elements onto any part of the park, upon any street or other
public place; provided, further, that if public receptacles are not available,
all litter shall be carried from the park by the person responsible for its
presence and properly disposed of elsewhere.
As to private premises an owner shall at all times maintain his or her
or its premises free of litter, except that this section shall not prohibit
storage of litter in private receptacles; nor shall any person throw or deposit
litter on any private premises.

Any person who violates the foregoing sections shall, upon conviction
before the Judge of the City Court, be guilty of an offense and be subject
to a fine of not more than $250 for each offense and/or imprisonment for not
more than 15 days.
