[HISTORY: Adopted by the City Council of the City of Corning 8-5-1991. Amendments noted where applicable.]
This chapter shall be known as the "Solid Waste Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
[1]ASHES
The residue from wood or coal and other combustible materials, excluding any ashes from an industrial process.
AUTHORIZED COMMERCIAL COLLECTOR
A person, firm or corporation licensed to collect, convey and dispose of garbage, rubbish or recyclables by the city.
BULKY WASTE
Not limited to furniture, carpet, television sets, plumbing fixtures, large crates, tools, machinery or parts thereof and similar items.
CITY
The City of Corning, New York.
CITY DISPOSAL BAG
Any plastic bag distributed solely by the city or its agents which shall bear an identification mark established by the city. This shall be the only means by which city residents can dispose of their garbage and rubbish by city haulers.
CITY USER
A person who purchases city disposal bags and uses them in accordance with this chapter.
CORRUGATED
Double layered cardboard paper material compound with ribbed inner sections between layers.
COUNTY
The County of Steuben, New York State and its regulatory agencies.
GARBAGE
Every waste accumulated of animal, vegetable, fruit or similar organic matter that attends the preparation, use, cooking, dealing in or storage of meat, fish fowl, fruit or vegetable.
GLASS CONTAINERS
Clean bottles and jars made of clear, green or brown glass.
NEWSPAPERS
Clean, dry paper of the type commonly referred to as "newsprint." Expressly excluded are newspapers that have been soiled.
NONCOLLECTIBLES
Includes but not limited to paint, poisons, acids, caustics, explosives, fuels, motor oils and other hazardous materials that may cause damage or injury to collection equipment or personnel, human or animal excrement, dead animals, dirt, motor vehicle tires, stone, ashes, bulky waste, construction and demolition materials, appliances, furniture and yard waste.
PERSON
Any natural person, firm, copartnership, association or corporations.
RECYCLABLE MATERIALS or RECYCLABLES
Those materials specified by New York State and the County of Steuben for collection in accordance with Steuben County Recycling regulations.
RUBBISH
Solid waste exclusive of garbage and recyclables and noncollectibles, nonrecyclable glass, metals, paper or plastic, plant materials, wood, nonputrescible solid waste, leather, rubber (excluding motor vehicle tires) and crockery.
SOLID WASTE
Garbage, rubbish and recyclables.
TIN
Clean cans that have a rim on each end. Both ends and label should be removed and flattened.
YARD WASTE
Fallen leaves, woody brush, grass clippings and other vegetative waste.

The operation for collection, removal and disposal of solid waste in the City of Corning shall be under the jurisdiction of the Superintendent of Public Works, who is hereby empowered to make and publish regulations concerning the days of collection, container location and any and all regulations pertaining to the collection and disposal of wastes.

The Superintendent of Public Works is hereby empowered to propose all charges in relation to the collection and disposal of solid waste to users of the City of Corning Solid Waste Collection System. Rates shall be established by resolution of the City Council.
A. 
The container shall be maintained in good condition by the owner thereof and shall not be permitted to have any ragged or sharp edges or any other defects liable to hinder or harm the person collecting the contents thereof.
B. 
Should the container deteriorate to such an extent that the handles thereof become dangerous and liable to injure or hinder the person collecting the contents of said container, or should it leak, it must be replaced by a proper container within one week after receipt of a written notice from the Superintendent of Public Works of said condition.

C. 
It shall be the duty of each person to provide himself/herself with the approved container for garbage(s), rubbish and recyclables to hold the waste accumulation between periods of collection by the Superintendent of Public Works or authorized commercial collector.

Said containers shall be kept covered at all times with proper tight-fitting covers, except while garbage and rubbish is being put into such cans or while the same is being emptied. It shall be unlawful for anyone other than the tenants or occupants of the premises at which garbage containers are stored or regularly authorized employees of the Department of Public Works, its agents or authorized commercial collector to disturb any container or to remove the covers or any of the contents thereof. No person shall cause the contents thereof to be strewn or scattered on the lawns, sidewalks, streets, alleys, parks, playgrounds, empty lots or other public places in the City of Corning, New York.
The subscribers of city collection services must place all garbage and rubbish in city disposal bags, which shall contain no more than 40 pounds of collectible material per bag, which must be set at curbside no earlier than 2:00 p.m. on the day before scheduled collection and not later than 6:00 a.m. the day of scheduled collection. There shall be no recyclables or noncollectibles in the city disposal bags. No container shall be left at curbside after 9:00 p.m. on the day of its scheduled collection.
A. 
It shall be mandatory for all residents and businesses to separate recyclables from all other solid waste. Separate bundles or containers shall be placed curbside for collection.
B. 
Collection of recyclable material from City of Corning customers will only be performed in conjunction with bag collection. Recyclable material will only be collected by City of Corning haulers when placed along side a city collection bag.
A. 
Limitations on properties served. It shall be the duty of every person who accumulates garbage, rubbish and recyclables to cause such garbage, rubbish and recyclables to be removed and disposed of.
B. 
Availability and extent of service. Garbage and recyclables shall be collected once per week from the residential and business sections, and the Superintendent of Public Works is hereby authorized to arrange date schedules for the various sections of the city.

C. 
Responsibility of employees. Each and every agent, officer or employee of the city engaged in the work of collection and removing of garbage, rubbish and recyclables from the premises shall in no way interfere with, disturb, break, destroy, handle, take or use any articles or substance or trespass upon any property of the householders, except insofar as the requirements of such collections shall warrant.

It shall be unlawful for any person, firm or corporation to engage in the business for hire of collecting, handling or transporting through the streets or public ways of the City of Corning any solid waste generated in the territorial limits of the City of Corning without first obtaining a license to engage in such business. Every person, firm or corporation desiring to engage in such business shall make application to the City Clerk by setting forth the name of such person, firm or corporation, the residence of an individual, or the address and place of business of firm or corporation, and pay a fee for such license in the sum as set forth from time to time by resolution of the City Council[1] for each vehicle to be used in the conduct of such business. Each such license so issued shall expire on the 30th day of June following such date of issue. The City Clerk shall, before issuing such a license, require the owner to get written approval from the Superintendent of Public Works to the effect that the vehicle to be used for such purposes is satisfactorily constructed to prevent littering of the city streets.

It shall be unlawful for any person, firm or corporation to place or cause to be placed in or upon any public street or alley of the City of Corning any solid waste or any other type of waste or rubbish, except when in accordance with a schedule of collection as authorized by the Superintendent of Public Works.
It shall be unlawful for any person, firm or corporation to dump household or business-type garbage, rubbish or recyclable in city-maintained trash containers, such as in parking lots, parks, upon streets and alleys, simply to avoid paying for said services.

In addition to any regulations contained in Chapter 190 of the Code of the City of Corning, subscribers to commercial curbside collection services shall comply with the following:
A. 
Subscribers must place all solid waste in disposal containers which must be set curbside, or at the edge of the pavement if there is no curb, no earlier than 2:00 p.m. on the day before scheduled collection. No container shall be left curbside after 9:00 p.m. on the day of scheduled collection.
B. 
Other than for collection purposes during the times above, no garbage, rubbish or disposal containers shall be left within the City's right-of-way.

Any person violating any of the terms of this chapter shall, upon conviction thereof, be punished by a maximum fine of $250 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.
