It shall be unlawful for any person under the age of 18 years to be or remain in or upon any of the streets, highways, alleys, parks or public places in this city, or be in or upon any automobile or other vehicle in or upon any such places, between the hours of 10:00 p.m. and 5:00 a.m., unless such person is accompanied by his or her parent, guardian or other person having the legal custody of such minor person, or is in the performance of an errand or duty directed by such parent, guardian or legal custodian, or is in such legal recognized employment as to make it necessary to be in or upon such places within or during said specified hours, or if the minor is traveling in a direct route to his or her residency from an adult-supervised or adult-sponsored religious, school, civic, not-for-profit, recreational or entertainment activity or adult-supervised or -sponsored organized dance. This exception, however, shall not apply when such minor shall be playing or unnecessarily loitering in or upon any such place.

It shall be unlawful for any parent, guardian or other person having the legal care and custody of any person under the age of 18 years to allow, permit or require any such minor to go in or be in or upon any of the streets, highways, alleys, parks or public places in this city, or be in or upon any automobile or other vehicle in or upon any such places, except accompanied by an adult person, between the hours of 10:00 p.m. and 5:00 a.m., unless a reasonable necessity therefore exists.
Any police officer of this city is hereby authorized to arrest without a warrant any person willfully violating any of the provisions of this chapter and may detain such person for a reasonable time in which complaint can be made, and an appearance ticket shall be issued for appearance at the next session of Corning City Court.

No minor arrested under this chapter shall be placed in confinement until reasonable effort shall have been made to locate and verbally notify the parent, guardian or legal custodian of such minor at the address given by him or her by such minor if the same be within the City or Town of Corning or any town adjacent thereto within the County of Steuben.

Any person violating any of the provisions of § 96-1 or § 96-2 hereof shall be punished by a fine of not more than $250 or imprisonment for not more than 15 days, or both such fine and imprisonment.
