Pursuant to New York State Home Rule Law, the City Council,
in order to ensure the proper protection, health, safety and welfare
of persons in the City, finds it to be in the public interest to prohibit
the discharge of firearms or other dangerous weapons within the city
limits.
This chapter is made and enacted pursuant to the legislative
authority vested in the City Council of the City of Corning by the
provisions of General City Law, Municipal Home Rule Law, and the City
Charter of the City of Corning, as amended.
As used in this chapter, the following terms shall have the
meaning indicated:
BOW
A weapon consisting of a bow, string, and either compound
or recurve limbs.
CITY LIMITS
The geographic boundary lines of the City of Corning, New
York.
CROSSBOW
A weapon consisting of a bow, string, and either compound
or recurve limbs mounted on a stock.
FIREARM
Any rifle, shotgun, or other weapon defined in § 265.00
of the Penal Law of the State of New York, or any weapon described
in § 265.05 of the Penal Law of the State of New York.
No person, other than in self-defense or in the discharge of
official duties, shall willfully discharge within the City Limits
any firearm or any bow or crossbow as defined in New York State Department
of Environmental Conservation Law.
The following uses shall not be limited by this chapter:
A. An indoor licensed facility designated and constructed as a shooting
range, as authorized by the applicable section(s) of the Code of the
City of Corning and properly approved and permitted by the City of
Corning and all other required agencies.
B. Any firearm using blanks discharged in a ceremonial function as approved
by the Director of Public Safety or his/her designee.
The Police Department shall bear primary responsibility for
enforcement of the provisions of this chapter.
A. The Police Chief, Fire Chief, Code Enforcement Officer and their
designees are authorized to enforce the provisions of this chapter.
B. The Police Chief, Fire Chief, Code Enforcement Officer and their designees are authorized to issue appearance tickets for a violation of this chapter as provided in Chapter
5 of the Code of the City of Corning.
Any person violating any provision of this Chapter shall be
punished for each offense by a fine of not more than $250 or imprisonment
for not more than 15 days, or both such fine and imprisonment.
