As used in this chapter, the following terms shall have the meanings indicated:
SPECIAL EVENTS
Those activities sponsored or cosponsored by a nonprofit or for-profit organization that will occupy or utilize city-owned parks, streets, plazas and/or will disturb or require normal traffic patterns to be altered.

A special event may take place following the procedure set forth hereinafter in § 194-5, Condition on permits and restrictions, upon application therefor to the City Clerk 60 days prior to the event, along with agreement to compensate the City for use of City streets, parks and plazas based on the payment according to the following fee structure at the conclusion of said special event.

The fee for permit shall be that percentage as set forth, from time to time, by resolution of the City Council of the entry fee or participation charge paid to the sponsoring organization by for-profit organizations, commercial organizations or business organizations. In the case of a special event sponsored only by a nonprofit organization, the permit fee shall be as set forth from time to time by resolution of the City Council, except that no fee shall be charged for participation by any recognized local nonprofit, religious, charitable, educational or civic organization.[1]

A. 
Permission to hold a special event may be granted only by the City Council, subject to approval by the Director of Public Safety or his/her designee, with view to prevention of undue noises, prevention of fire hazards and to protect public safety, health and welfare. No permit for a special event shall be issued, and any outstanding permit may be revoked, if the City Council determines that such a special event includes any activity which in the judgment of the City Council will disturb the order and peace of the City or will jeopardize the health, safety or welfare of the public.

B. 
Permits may be issued by the sponsor of a special event to any person, firm, corporation, association, club, copartnership, society or other organization to travel by foot or vehicle within the area to be utilized by a special event for the purpose of vending wares or merchandise.

C. 
The applicant shall provide insurance coverage, security, traffic control and cleanup measures to the satisfaction of the City Manager.

D. 
The Director of Public Safety or his/her designee may revoke a permit or further restrict its conditions at any time before or during the event if the activity may, in the judgement of the Director of Public Safety or his/her designee, disturb the order and peace of the City or jeopardize the health, safety or welfare of the public.

Failure to comply with stated permit requirements is punishable by a fine not to exceed $250 or imprisonment for not more than 15 days, or both such fine or imprisonment.
