Docks on Lake George owned by the Village shall be used by owners of pleasure boats according to the rules and regulations prescribed by this chapter, to wit:
A. 
Boats or watercraft used for hire or commercial purposes are prohibited from utilizing the docks for any purpose.

B. 
The following charges shall apply to all boats moored at the Village docks at any time of day: $3 per hour, per boat, with a minimum one-hour charge of $3.

C. 
No boat may be moored for a period longer than 20 consecutive hours.

D. 
Operators of boats moored shall be responsible to display a "pay and display" receipt on the windshield or dashboard of their boat on the dockside of the vessel in clear sight of viewers. Only "pay and display" purchased at the kiosk for boats may be displayed on any boat.

E. 
No boats or watercraft of any description, except those authorized by the Village Board of Trustees, e.g., police, fire, special event vessels, shall be moored between the hours of 5:00 a.m. and 9:00 a.m. daily.

A. 
Any person causing or allowing a violation of any section of Chapter 95 by failing to pay or satisfy mooring fees in accordance with the above regulations shall be prosecuted, and any conviction shall constitute a violation. Each six consecutive hours shall be a separate violation of this chapter.
B. 
Fines.
(1) 
Any person who violates any provision of this chapter shall be punished by payment of the following fines:

All such fines unpaid within 15 days of issue shall double in penalty.

A. 
The Village reserves the right to remove, immobilize and store any boat on which there are persistent, willful and several violations as determined by the Mayor as provided for in this § 95-3. Such boat shall be towed and stored at the expense and risk of the owner.
B. 
A boat shall be promptly released to its owner upon payment of all charges, including an administrative surcharge of $100.
C. 
In the event a boat is berthed at the docks in violation of this Chapter 95, or in the event of any occurrence on or at the docks which the Mayor finds to be an immediate threat to the health, safety or welfare of the public, the Mayor is empowered by order and after any attempt to resolve the issues giving rise to the prospective ban as the Mayor in his or her discretion may determine, to order the removal, immobilization and/or storage of any such boat, and/or to issue a temporary or permanent ban of the boat and any individual(s) from the Village docks for any violation of this chapter. The owner of any boat or any individual so banned by the Mayor may apply to the Board of Trustees for a hearing from any such ban issued by the Mayor within 120 days of the date of issuance of such ban, and the Board of Trustees shall hear any such appeal within 30 days of the date of the filing of such appeal. There shall be no stay of any such order by the Mayor pending hearing before the Board of Trustees. The Board of Trustees shall issue a determination on such appeal within 30 days of the hearing of any such appeal and the Board may modify, overturn or affirm any such ban issued by the Mayor.

Docks on Lake George owned by the Village located on Lower Amherst Street have been erected for the sole use of vessels designated to assist in fire and rescue operations, law enforcement, and lake stewardship.
A. 
No boats or watercraft of any description except those authorized by the Village Board of Trustees may be moored at any time.
B. 
No persons are permitted to utilize the docks without authorization at any time for any recreational uses.
Any person who violates this article shall constitute a violation and shall be liable to pay a fine of $100 upon conviction.

If any clause, sentence, paragraph, subdivision, section, or part of this article or the application thereof to any person, individual, corporation, firm, partnership, entity, or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part of this article, or in its application to the person, individual, corporation, firm, partnership, entity, or circumstance directly involved in the controversy in which such order or judgment shall be rendered.

The section numbers, chapter number and structure of this article may be renumbered, realigned and codified as part of inclusion in the Code of the Village of Lake George. No such renumbering, realignment or codification shall be deemed to impair the legality of the content of this article.

This article shall take effect immediately upon filing in the office of the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
