As used in this chapter, the following terms
shall have the meanings indicated:
GARBAGE
Organic waste of meat, bones, fish, fruit, vegetables or
any animal or vegetable matter, including cans or containers and packages
that have contained food materials.

LITTERING
The throwing or depositing on any public or private lands
of any refuse, trash, garbage, rubbish, paper or other offensive materials.
REFUSE
Inorganic waste such as bottles, glass, crockery, metals
or other noncombustible matter, including grass clippings and leaves.
RUBBISH
Paper, wood, leather, cloth, plastic or other combustible
matter.
YARD WASTE
Grass clippings, leaves, cuttings and other debris from shrubs,
hedges, tree branches less than three inches in diameter and four
feet in length, and other vegetation. "Yard waste" shall not be construed
to include garbage, recyclable material, construction and demolition
debris, or sod or soil.

It shall be unlawful for any person to litter
or to dump, deposit or permit to be deposited upon any public or private
property or upon any street, sidewalk, park or other public place
in the Village of Lake George any garbage, rubbish or other objectionable
waste, except as hereinafter provided.
No person or persons shall dump or deposit any
garbage, rubbish or other objectionable waste elsewhere than at the
municipal landfill site operated by the Town of Lake George.

A. Grass, leaves and other yard waste shall be placed
in biodegradable paper bags approved for such use by the Village of
Lake George. Such bags shall be placed at curbside during any appropriate
days, except as otherwise noted: during annual designated cleanup
days, at which time yard waste and wood branches no longer than three
feet in length and one inch in diameter may be placed in bulk at curbside
for pickup.
B. It shall be unlawful for any person other than authorized
Village employees to disturb, remove or willfully and maliciously
tip over and spill the contents of plastic bags, paper bags or waste
receptacles.
C. It shall be unlawful for any person to place any container holding any refuse, waste or garbage on the public right-of-way beyond the curbline of any street within the limits of the Village of Lake George except as specified in §
137-8.

Nothing in this chapter shall be construed to
prohibit the dumping of dirt, sand, gravel, ashes, stones, slate,
blacktop or other suitable fill material, provided that permission
has been obtained from the Director of Public Works, who shall designate
the disposal location.

At least once in each calendar year, the Village
may designate a cleanup week and give notice thereof in the official
newspaper to residents of the Village. At the time specified in said
notice, it shall be the owner's or occupant's responsibility, as the
case may be, to place acceptable items between the sidewalk and curb
or in the front yard of the premises from which garbage, refuse and
rubbish is being collected. Such acceptable items shall be neatly
piled or stacked. Between the time when the owner or occupant places
the acceptable items for collection and the actual collection, said
owner shall be charged with the responsibility of discouraging scavenger
operations of said volume to be collected.
The Village shall have the right to order removal
of offensive rubbish, garbage or debris stored or existing in violation
of this chapter from the private property and to charge the property
owner the costs for such removal upon the following:
A. Inspection report of the Building Inspector, in writing,
noting violations.
B. Notification of the property owner, in writing, with
three days' notice to correct violation of this chapter.

No garbage or refuse of any kind incidental
to the operation of any residence or commercial establishment may
be deposited in any trash receptacle placed upon the public street
by the Village of Lake George.

Each violation of this chapter shall be punishable
by a fine of not less than $100 nor more than $500.
