A violation of this chapter is hereby declared
to be an offense punishable by a fine not less than $250 for each
and every day the violation exists, or imprisonment for a period not
to exceed six months, or both, for conviction of a first offense.
Conviction of a second offense, both of which were committed within
a period of five years, is punishable by a fine of not less than $500
for each and every day the violation exists, or imprisonment for a
period not to exceed six months, or both. Conviction for a third or
subsequent offense, all of which were committed within a period of
five years, is punishable by a fine of not less than $750 for each
and every day the violation exists, or imprisonment for a period not
to exceed six months, or both.
Any permit or approval granted under this chapter
that is based upon or is granted in reliance upon any material misrepresentation,
or failure to make a material fact or circumstance known, by or on
behalf of an applicant, shall be void. This section shall not be construed
to affect the remedies available to the Village under this chapter.
Whenever a violation of this chapter is alleged
to have occurred, any person may file a complaint in regard thereto.
All such complaints shall be filed with the Zoning Administrator who
may direct that such complaint be properly investigated and a report
thereon be made to the Village Board.

If any clause, sentence, paragraph, subdivision, section, or
part of this chapter or the application thereof to any person, individual,
corporation, firm, partnership, entity, or circumstance shall be adjudged
by any court of competent jurisdiction to be invalid or unconstitutional,
such order or judgment shall not affect, impair or invalidate the
remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, subdivision, section, or part of this chapter,
or in its application to the person, individual, corporation, firm,
partnership, entity, or circumstance directly involved in the controversy
in which such order or judgment shall be rendered.

This local law shall take effect upon filing with the office
of the New York State Secretary of State.
