The purpose of this article is to allow for
amendment to this chapter whenever the public necessity and convenience
and the general welfare require such amendment, by following the procedure
below.
When directed by the Village Board, the Village
Clerk shall submit a copy of the proposed amendment to the Adirondack
Park Agency for a determination as to whether the proposed amendment
is subject to Agency approval under § 807 of the Adirondack
Park Agency Act. The Village Clerk shall simultaneously refer such proposed
amendment to the Planning Board, and where required by § 239-m
of the General Municipal Law, to the County Planning Agency having
jurisdiction, for the report and recommendations by those bodies to
the Village Board.
The procedure as to notice of public hearing,
public hearing on, and enactment of a proposed amendment shall follow
and be governed by § 7-708 of the Village Law, and § 239-m
of the General Municipal Law, including all subsequent amendments
thereto. Adirondack Park Agency approval is required prior to final
enactment by the Village Board. Notice of the decision of the Village
Board shall be sent promptly to the Adirondack Park Agency.
The Zoning Administrator and the Village Clerk
shall each maintain records of amendments to the text of this chapter
and of the Official Zoning Map and Park Plan Map.
