The Board of Supervisors of Middle Smithfield Township, Monroe County, Pennsylvania, deems it is necessary for the general protection of the public and in the interest of the general welfare of the Township of Middle Smithfield that parking be regulated on certain township roads, highways, intersections or other public property specified as "No Parking Areas."
It shall be unlawful to park any vehicle, whether operated under its own power or not, at any time on the side of any road or intersection in the Township of Middle Smithfield where such parking has been prohibited by resolution of the Board of Supervisors of the Township of Middle Smithfield, duly adopted and recorded in the minutes of the Board, and where signs notifying the public of such parking prohibition have been erected in accordance herewith.
The Board of Supervisors may from time to time, by resolution, prohibit the parking of vehicles upon portions or sides of the roads in the Township of Middle Smithfield during such time as may be fixed by the Board of Supervisors where signs notifying the public of such parking prohibition have been erected in accordance herewith.
A. 
The following words and phrases, when used hereinafter, have the meanings ascribed to them in this section, except where the context clearly indicates or requires a different meaning. The singular shall include the plural and the masculine shall include the feminine.
B. 
As used in this article, the following terms shall have the meanings indicated:
DISABLED VEHICLE
Any vehicle which is disabled or inoperable in such a manner and to such an extent that it is impossible to avoid stopping and temporarily leaving the vehicle in that position. A vehicle which is not properly equipped with winter or snow tires for winter driving conditions shall not for that reason alone be deemed to be disabled.
EMERGENCY CONDITION
An emergency condition shall exist where there is a snow fall which measures two inches or more on the ground and is the result of one continuous snowfall or any accumulation of hail, sleet, freezing rain or ice.
HIGHWAY
The entire width between the boundary lines of every road and way publicly maintained, when any part thereof is open to the use of the public for purposes of vehicular travel, including a roadway open to the use of the public for vehicular travel on the grounds of a public school or public or historic park.
PARKING
The halting of a vehicle, whether occupied or not, except momentarily, for the purposes of and while actually engaged in loading or unloading property or passengers. As used herein, however, the term shall not include a Police, Fire Department or rescue vehicle, ambulance or township vehicle on official township business.
ROAD
All streets, lanes, alleys, parcels or strips of land or other ways or places of ingress or egress open to the use of the public for vehicular travel, excluding, however, such ways upon grounds owned by private persons or other private entities.
TOWNSHIP
The Township of Middle Smithfield, Monroe County, Pennsylvania.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway or road, except devices used exclusively upon rails or tracks.
During any emergency condition, as hereinbefore defined, parking within the cartway or shoulder area of any road lying and situate in the township is prohibited at any time. Any individual having knowledge of said condition shall take immediate steps to remove from the cartway or shoulder of any road any vehicle owned or operated by said individual parked there prior to the emergency condition. An emergency condition shall terminate once the streets have been plowed and cindered and the snow, freezing rain and sleet have ceased falling for a continuous period of two hours; provided, however, that this section shall not apply to a disabled vehicle which is stopped on a road or highway in the township so long as the vehicle is removed in a period of 10 hours from the time it has become disabled.
The Roadmaster of Middle Smithfield Township or, with his consent, any other employee of Middle Smithfield Township engaged in road work is hereby authorized to cause to be towed any vehicle abandoned or parking upon any public highway or street in violation of the terms and provisions of this article and to take any said vehicle to the nearest garage or other place of safety. The registered owner of any such vehicle shall be promptly notified, in writing, of the fact of the removal and of the place to which said vehicle has been removed and where said owner may obtain the same upon payment of any and all towing and storage charges.
Any person who violated any provision of this article shall, upon conviction, be sentenced to pay a fine of not more than $15 and costs. It shall be the duty of the Township Roadmaster and/or of parking enforcement personnel of the township to report all violations of any provisions of this article, indicating, in each case, the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The Township Roadmaster and/or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this article. The notice shall contain instructions to the owner or driver of the vehicle that if he will report to the Township Office and pay the sum of $5 within 48 hours after the time of the notice, that act will save the violator from prosecution and from payment of the fine and costs prescribed in the first sentence of this section.

All vehicles approaching a stop intersection shall come to a full stop within a reasonable distance before entering such intersection.
Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine as provided pursuant to the Pennsylvania Vehicle Code.[1]
