Except as set forth in or in addition to definitions
included elsewhere in this chapter, as used in this chapter, the following
terms shall have the meanings indicated:
ACCESS
A public or private right-of-way providing the ability to
enter, approach or pass to and from one area to another area.
ACCESSORY BUILDING
A building subordinate to, and located on the same lot with,
a main building, the use of which is clearly incidental to that of
the main building or to the use of the land and which is not attached
by any part of a common wall or roof to the main building.
ACCESSORY USE
A use of a building, lot or portion thereof which is customarily
incidental and subordinate to the principal use of the main building
or the lot. Swimming pools and tennis courts shall be considered accessory
uses.
ADMINISTRATOR
The official charged with the administration and enforcement
of this chapter.
AGRICULTURAL NURSERY
An open space or building where agricultural products such
as trees, plants, etc., are grown for experimental purposes, transplanting
or for sale.
ALLEY
A public right-of-way which affords pedestrian access and
a secondary means of vehicular access to the side or rear of abutting
property.
AMENDMENT
A change in this chapter and/or Zoning Map granted by the
Town Council after review and comment by the Town Planning Commission
and the required public hearing.
APARTMENT HOUSE
A multifamily structure originally intended, arranged or
designed to be occupied by three or more families, each in an individual
dwelling unit and living independently of each other. The number of
families in permanent residence shall not exceed the number of dwelling
units provided. Entranceways through the structure to the units may
be either common or separate, and each lot on which the building is
located shall be held in single ownership, even though individual
units may be sold in accordance with this chapter. Such term shall
not include a row house or townhouse.
ARCHITECT, REGISTERED
A licensed professional architect, registered in the Commonwealth
of Virginia by the Department of Professional and Occupational Regulation
as an architect.
AUTOMOBILE PARKING LOT, COMMERCIAL
A lot or portion thereof, other than an automobile sales
lot, held out or used for the storage or parking of six or more motor
vehicles for a consideration, where service or repair facilities are
not permitted. Such parking lot shall not be considered an accessory
use nor shall it be used for the storage of dismantled or wrecked
motor vehicles, parts thereof or junk.
AUTOMOBILE REPAIR
Any place of business, with or without pumps or underground
storage tanks, having as its purpose the servicing and repair, at
retail, of motor vehicles, but not including a paint or body shop,
machine shop or vulcanizing shop. All repairs must be conducted in
a fully enclosed building.
AUTOMOBILE SALES LOT
A lot arranged, designed or used for the storage and display
for sale of any new or used motor vehicle capable of independent operation
or any type of temporary auto trailer and recreation vehicle, provided
that the travel trailer or recreation vehicle is unoccupied, and where
repair work is done wholly enclosed within a building. All vehicles
to be sold must be operable, except for vehicles awaiting immediate
repair.
BASEMENT
A portion of a building having 50% or more of the total exterior
wall area exposed.
BED-AND-BREAKFAST INN
A single-family dwelling where, for compensation, lodging
and breakfast are provided to registered guests only. Registration
shall not exceed a period of seven consecutive calendar days. A bed-and-breakfast
inn shall not qualify as a home occupation but shall be allowed by
a special use permit in all zones, provided further that off-street
parking shall conform to the requirements for hotels and motels. The
establishment must be occupied and managed by the owner of the property
and a business license must be acquired in connection with a special
use permit for a bed-and-breakfast inn.

BLOCK
The property bound on all sides by one side of a street or
a combination of street line, railroad right-of-way, unsubdivided
land, river, live stream, stream bed or any other barrier to the continuity
of development.
BOARD
The Board of Zoning Appeals of the Town of Stanley, Virginia.
BOARDINGHOUSE
A building where, for compensation, lodging and meals are
provided for at least three persons and not more than 13 persons.
A boardinghouse is to be distinguished from a hotel. No provisions
shall be made for cooking in individual rooms or suites.
BUILDING
Any structure or extension thereof or addition thereto having
a roof supported by such things as columns, posts, piers or walls
which is permanently affixed to the land and intended for the shelter,
business, housing or enclosing of persons, animals or property of
any kind.
BUILDING AREA
The aggregate area occupied by all buildings on a lot as
measured on a horizontal plane around the periphery of the facades
and including the area under the roof of any structure not having
walls.
BUILDING INSPECTOR
An official designated by the Town of Stanley, Virginia,
to be responsible for certifying building inspections.
BUILDING, MAIN
A building in which the principal use of the lot is conducted.
BUILDING SETBACK LINE
The line parallel to the street at a distance therefrom equal
to the depth of the front yard required for the district under consideration.
CELLAR
A portion of a building having less than 50% of the total
exterior wall exposed.
CEMETERY
A place of burial of the human dead or remains of human dead.
CHANNEL
The identifiable bed and banks of a stream which convey a
normal, constant or intermittent flow of a stream.
CHURCH
A building set apart or consecrated for public assembly to
practice one's religion.
CLINIC
An establishment where human patients who are not lodged
overnight are admitted for examination or treatment by physicians
or dentists.
CLUB (PRIVATE)
Those associations or organizations of a fraternal or social
nature not operated or maintained for profit. This shall not include
a nightclub or other institution operated as a business.
COMMISSION
The Planning Commission of the Town of Stanley, Virginia.
COMMON OPEN SPACE
Any parcel or area of land or water essentially unimproved
and set aside, dedicated, designated or reserved for public or private
use or enjoyment or for the use and enjoyment of owners and occupants
of land adjoining such open space, provided that improvements shall
be limited to those that are designed to be incidental to the natural
openness of the land.
CONVENIENCE STORE
A single store, with a ground floor with 4,000 square feet
or less which offers for sale merchandise. To sell bulk petroleum
products, a special use permit will be required.
COVERAGE
That percentage of the plot or lot area covered by all buildings
and impervious materials. Any area of a lot covered with porous materials
will not be included in the calculation of coverage.
DENSITY, GROSS
The number of dwelling units per acre of gross area of a
site.
DEVELOPMENT
The division of a parcel of land into two or more parcels;
the construction, reconstruction, conversion, structural alteration,
relocation or enlargement of any building or other structure; any
mining, excavation or landfill; any use or change in the use of any
building or other structure or land; or the extension of use of land
for which permission may be required pursuant to the Code of Virginia,
as amended.
DISTRICT
A portion of the Town of Stanley within which, on a uniform
basis, only certain uses of land and buildings are permitted as set
forth in this chapter and within which certain lot areas and other
uniform requirements are established.
DRAINAGE EASEMENT
A limited property right assigned by deed or other legal
means permitting the use of a specified area for the installation
and maintenance of stormwater sewers or drainage ditches or the restriction
of areas along a natural stream or watercourse for preserving the
channel and providing for the flow of water therein to safeguard the
public against flood damage.
DRIVEWAY
A space or area providing access specifically designated
and reserved on a lot for the movement of vehicles from one lot to
another or from a lot to a public street.
DUPLEX
A two-family residential structure with each unit having
its own exterior entrance and its own kitchen and bath facilities;
the residential units may be arranged one above the other or be semidetached.
DWELLING
A building or portion thereof which is used or intended to
be used exclusively for residential purposes and contains one or more
dwelling units. A dwelling shall be constructed in accordance with
the Uniform Statewide Building Code.
DWELLING, ATTACHED
A dwelling having any portion of each of two walls in common
with adjoining dwellings.
DWELLING, MULTIFAMILY
A structure originally arranged or designed to be composed
of three or more dwelling units, with the number of families in residence
not exceeding the number of dwelling units provided.
DWELLING, SEMIDETACHED
One of two buildings arranged or designed as dwellings, located
on abutting walls without openings and with each building having a
separate lot.
DWELLING, SINGLE-FAMILY
A residential dwelling unit, other than a mobile home, designed
for and occupied by one family.
DWELLING, TEMPORARY
A portable dwelling not necessarily attached to a permanent
foundation. These units shall be used only as specified herein.
DWELLING, TWO-FAMILY
A residential building containing not more than two dwelling
units within the single building, with such units arranged one above
the other or side by side and such structure designed for occupancy
by not more than two families.
DWELLING UNIT
One room, or rooms connected together, constituting a separate,
independent housekeeping establishment for owner occupancy or for
rental or lease on a weekly, monthly or longer basis and physically
separated from any other rooms or dwelling units which may be in the
same structure and containing independent cooking and sleeping facilities
and containing not less than 600 square feet of residential floor
area. Each dwelling unit shall be constructed in accordance with the
requirements of the Uniform Statewide Building Code.
A.
MODULAR UNITA factory-fabricated transportable building designed to be used by itself or to be incorporated with similar units at a building site into a modular structure. The term is intended to apply to major assemblies and does not include prefabricated panels, trusses, plumbing trees and other prefabricated subelements incorporated into a structure and containing independent cooking and sleeping facilities and containing not less than 800 square feet of residential floor area. Such units shall meet the requirements of the Uniform Statewide Building Code.
B.
SECTIONAL HOMEA dwelling made of two or more modular units transported to the home site, put on a foundation and joined to make a single dwelling. This type of unit is included in the definition of "dwelling unit." Such units shall meet the requirements of the Uniform Statewide Building Code.
EASEMENT
A grant by a property owner of the use of his land or a portion
thereof to another party for a specific purpose. The initial property
owner in the agreement may be compensated for the use of his property.
ENGINEER, REGISTERED
A licensed professional engineer, registered in the Commonwealth
of Virginia by the Department of Professional and Occupational Regulation
as an engineer.
EROSION
The detachment and movement of soil or rock fragments by
water, ice and gravity.
ESSENTIAL SERVICE
Structures and physical improvements, whether publicly or
privately owned, necessary to permit the orderly development of an
area, including such facilities as streets; water, sewerage, gas,
telephone and electric lines; supporting structures, such as manholes,
catch basins, pumping stations, solid waste collection stations, transformer
stations and utility poles; also including emergency service facilities
(fire, rescue, police and dispatching), but not including generating
or storage plants, processing stations, maintenance yards or administrative
headquarter facilities.
FAMILY
Any number of persons living together in a single dwelling
unit, but not including more than eight persons not related by blood,
marriage or adoption. Mentally retarded and developmentally disabled
family-care homes, foster homes and group-care homes are included
within this definition, subject to the above restriction.
FAST-FOOD ESTABLISHMENT
Any place or premises used for the sale, dispensing or serving
of food, refreshments or beverages in automobiles possibly utilizing
a drive-through lane and allowing the eating and drinking of the products
sold within the establishment within the building.
FENCE or WALL
A structure which permanently or temporarily prohibits or
inhibits unrestricted travel between properties or portions of properties
or between the street or public right-of-way and a property.
FLOODPLAIN
Sections of land which are subject to periodic flooding and
inundation as defined or approved by the Department of Housing and
Urban Development.
FLOODWAY
Any portion of a floodplain lying within 50 feet of the adjacent
channel edge of a natural stream or within 25 feet of the edge of
a lake or center line of any watercourse other than a natural stream.
FLOOR AREA, GROSS
The sum of the horizontal areas of the several floors of
a building, excluding basement space, but including the area of permanently
roofed porches and terraces. All dimensions shall be measured from
the outside face of exterior walls or from the center line of a party
or common wall.
FLOOR AREA, GROSS HABITABLE
The portion of gross floor area assigned for human habitation
and fully enclosed by the inside surfaces of walls, windows, doors
and partitions and having a headroom of at least six feet six inches,
including living, eating, cooking and other household space but excluding
garages, carports, porches, unheated sheds and basements. Attics or
portions thereof may be considered habitable floor area, provided
that they are fully finished and meet the proper height requirements.
FUNERAL PARLOR, FUNERAL HOME or MORTUARY
An establishment used for human funeral services, which must
include facilities on the premises for embalming and may or may not
include facilities for the performance of autopsies, other surgical
procedures or cremation.
GARAGE
A freestanding or attached building or an area included in
the principal building for utilization in the storage and maintenance
of one or more motor vehicles.
GARDEN APARTMENT HOUSE
A multifamily dwelling not exceeding three stories in height,
containing three or more separate dwelling units having either common
or separate entranceways on a lot held in single ownership, having
yards in common, but which may also have other joint facilities and
services. The term "garden apartment house" shall not be construed
to include a row house or townhouse.
HARD SURFACE
Concrete, blacktop, macadam or a similar surface.
HEALTH OFFICIAL (OFFICER)
The Director of the Page County Department of Health or his
designated deputy or a representative of the Virginia Department of
Health.
HEIGHT
The vertical dimension measured from the average elevation
of the finished lot grade at the front of the building to the highest
point of ceiling of the top story in the case of a flat roof, to the
deckline of a mansard roof and to the average height between the plate
and ridge of a gable, hip or gambrel roof.
HOME OCCUPATION
An occupation or profession which is clearly incidental to
the use of the lot and dwelling for residential purposes and which
complies with the standards and requirements of this chapter.
HOTEL
A building designed or occupied as the temporary abiding
place for 14 or more individuals who are, for compensation, lodged,
with or without meals, and in which no provision is made for cooking
in individual rooms or suites.
IMPERVIOUS MATERIALS
Materials that do not permit the natural absorption and permeation
of soils by rain or other surface water, including but not limited
to concrete, asphalt, chemical treatment of soils or artificial ground
covering.
IMPERVIOUS MATERIALS COVERAGE
That percentage of a lot or site covered by impervious materials,
which shall include facilities such as swimming pools, tennis courts
and other recreational courts as well as roads, walkways, patios,
driveways and parking areas.
JUNKYARD
Any land or building used for the abandonment, storage, keeping,
collecting or baling of paper, rags, scrap metals, other scrap or
discarded materials or for the abandonment, demolition, dismantling,
storage or salvaging of automobiles or other vehicles not in running
condition, machinery or parts thereof. The term "junkyard" shall include
the term "automobile graveyard," as defined in § 33.1-348
of the Code of Virginia, as any lot or place which is exposed to the
weather upon which more than three motor vehicles of any kind incapable
of being operated are placed.
KENNEL
Any building or land parcel used for the commercial keeping
of dogs and/or other household pets. The keeping of more than 10 such
adult animals on any one property shall be deemed to constitute a
kennel.
LAUNDROMAT
A building or part thereof where clothes or other household
articles are washed or dry-cleaned in self-service machines with a
capacity for washing not exceeding 25 pounds' dry weight and where
such washed clothes and articles may also be dried or ironed and no
delivery service is provided in connection therewith.
LAUNDRY
A building or part thereof, other than a laundromat, where
clothes and other articles are washed, dried and ironed or dry-cleaned.
LOADING SPACE
An off-street space not less than 12 feet in width, 60 feet
in length and with 15 feet of vertical clearance available for the
loading or unloading of trucks.
LOT
A parcel of land occupied or to be occupied by a building
and its accessory buildings or by a use and its accessory uses, together
with such open spaces as are required under the provisions of this
chapter, having at least the minimum area required by this chapter
for a lot in the zone in which such lot is situated and having its
principal frontage on a street which has been approved by the Town
as acceptable into the Town street system.
LOT AREA
The area contained within the lot lines of a lot, excluding
any portions of a street right-of-way.
LOT, CORNER
A lot abutting on two or more streets at their intersection.
LOT DEPTH
The average of the horizontal distances between front and
rear lines of a lot measured perpendicular to the street line.
LOT FRONTAGE
The horizontal distance between side lot lines measured along
the street line. The minimum lot frontage shall be the same as the
lot width, except that on curved alignments with an outside radius
of less than 500 feet, the minimum distance between the side lot lines
measured at the street line shall not be less than 75% of the required
lot width. In the case of a corner lot, either street frontage which
meets the minimum frontage required for that zone may be considered
the lot frontage.
LOT OF RECORD
A lot which has been recorded in the office of the Clerk
of the Circuit Court of Page County.
LOT, WIDTH OF
The horizontal distance between the side lines of a lot measured
along the building setback line.
MAINTENANCE GUARANTY
Any security, other than cash, which may be accepted by the
municipality for the maintenance of any improvements pursuant to the
provisions of this chapter.
MANEUVERING SPACE
An area directly related to required parking areas, designed
to permit easy vehicular movement. Maneuvering space shall not be
considered as part of any required parking space or loading space.
MANUFACTURE and/or MANUFACTURING
The processing and/or converting of raw, unfinished materials
or products, or either of them, into articles or substances of different
character or for use for a different purpose.
MANUFACTURED HOME
A structure, transportable in two or more sections, which
in the traveling mode is 10 body feet or more in width per section
or 40 body feet or more in length, or when erected on site is 800
or more square feet, and which is built on a permanent chassis with
permanent foundation when connected to the required utilities, and
includes the plumbing, heating and electrical systems contained therein.
The term "single-family dwelling" includes "manufactured homes" when
placed on a permanent foundation, converted to real property and taxed
as a site-built dwelling as provided by law.
MOBILE HOME
A structure, transportable in one or more sections, which
in the traveling mode is eight body feet or more in width or 32 body
feet or more in length, or when erected on site is 256 or more square
feet, and which is built on a permanent chassis and designed to be
used as a single-family dwelling with a permanent foundation that
meets or exceeds the current Uniform Statewide Building Code. The trailer must be connected to the required utilities
and includes the plumbing, heating and/or air-conditioning and electrical
system contained therein.
MOBILE HOME PARK
An area designed, constructed, operated, maintained and equipped
with public utilities, streets, recreation areas and spaces for two
or more mobile homes intended to be used for living facilities.
MOTEL
An establishment consisting of a group of living or sleeping
accommodations with bathroom and closet space, located on a single
lot and designed for use by transient automobile tourists and each
unit having its own parking space.
NONCONFORMING ACTIVITY (USE)
The otherwise legal use of a building, structure or tract
of land that does not conform to the use regulations of this chapter
for the district in which it is located either at the effective date
of this chapter or as a result of subsequent amendments to this chapter.
NONCONFORMING LOT
An otherwise legally platted lot that does not conform to
the minimum area or width requirements of this chapter for the district
in which it is located at the effective date of this chapter or as
a result of subsequent amendments to this chapter.
NONCONFORMING STRUCTURE
An otherwise legal building or structure that does not conform
to the lot area, yard, height, lot coverage or other area regulations
of this chapter or is designed or intended for a use that does not
conform to the use regulations of this chapter for the district in
which it is located either at the effective date of this chapter or
as a result of subsequent amendments to this chapter.
NONPROFIT ORGANIZATION
An organization or group whose charter prohibits profitmaking
endeavors and which enjoys tax-exemption privileges.
NURSING HOME (CONVALESCENT HOME; REST HOME)
A place containing beds for two or more patients, established
to render live-in and/or nursing care for chronic or convalescent
patients and which is properly licensed by the state, but not including
child-care homes or facilities for the care of drug addicts, alcoholics
or other patients requiring more extensive and/or intensive care than
is normally provided in a general hospital or other specialized hospitals.
OPEN SPACE
That space on the same lot with and contiguous to the principal
building or buildings which is either landscaped with shrubs, planted
grass or developed and maintained for recreation purposes, and excludes
that portion of the lot which is utilized for off-street parking purposes.
OVERHANG
Any projection, either roof, bay window or similar cantilevered
construction, which extends beyond the foundation of a structure.
No such construction shall project into any required yard more than
five feet.
PARKING SPACE
An area of not less than 10 feet wide by 20 feet long for
each automobile or motor vehicle, such space being exclusive of necessary
drives, aisles, entrances or exits and being fully accessible for
the storage or parking of vehicles.
PERFORMANCE BOND
Any security which may be accepted by the governing body
of the Town of Stanley for the purpose of ensuring compliance with
the provisions of this chapter, including but not limited to surety
bonds, cash escrow, cash bonds, certified checks, a letter of credit
from a bank or savings and loan association on certain designated
funds satisfactory to the governing body as to the bank or savings
and loan association, the amount and form.
PLANNED INDUSTRIAL DEVELOPMENT
An area of a minimum contiguous acreage as defined by this
chapter to be developed according to a plan as a single entity containing
one or more structures with appurtenant common areas to accommodate
industrial uses and any other uses incidental to the predominant uses
as may be permitted by this chapter.
PLANNED SHOPPING CENTER
A group of commercial establishments built on one tract that
is planned and developed as an operating unit; it provides on-site
parking in definite relationship to the type and total size of the
stores. The commercial establishments may be located in one or several
buildings, attached or separated.
PLAT
A map or maps of a subdivision or site plan and is used interchangeably
with "plan" in this chapter.
PORCH
An open, unenclosed stoop or paved terrace which may project
into a front or rear yard for a distance not exceeding eight feet
and into a side yard for a distance not exceeding five feet, but this
shall not be interpreted to include porches which may be enclosed
by removable windows, fixed canopies or screens. A porch or any portion
thereof shall not occupy more than 24 square feet of any side yard.
A one-story bay window or a chimney may project not more than three
feet into any required yard area.
PRESCHOOL CHILD-CARE FACILITY
A building or structure, however designated, other than public
facilities, operated for the purpose of providing care, guidance,
education or training or any part thereof to any child five years
old or younger during only part of the twenty-four-hour day for more
than five children not of common parentage. Such facilities shall
meet all applicable regulations of the Department of Health along
with the statewide and local building codes.
PRINCIPAL USE
The main purpose for which a lot or building is used.
PROFESSIONAL OFFICE
A structure used by a person or persons in offering a service
which requires specialized knowledge gained by intensive academic
preparation, such as medicine, law, engineering, dentistry and other
like endeavors, excepting any funeral home or any establishment where
goods are offered for sale.
PUBLIC UTILITY
Any person, firm, corporation, municipal department or board
duly authorized to furnish and furnishing, under federal, state or
municipal regulations, to the public, electricity, gas, steam, communications,
telegraph, transportation, water or like utilities.
RESTAURANT
Any establishment, however designated, at which food is sold
for consumption on the premises. However, a snack bar or a refreshment
stand at a public or community swimming pool, playground, playfield
or park operated solely by the agency or group operating recreational
facilities and for the convenience of the patrons shall not be deemed
to be a restaurant. "Restaurant" does not include take-out or drive-in
establishments which permit the consumption of food only within motor
vehicles.
RESTORATION, BEGINNING OF
The clearing of debris from an area, use or structure which
has been totally or partially damaged or destroyed.
RESUBDIVISION
A change in a plat of an approved or recorded subdivision or resubdivision if such change affects any street layout shown on such plat, affects any area reserved thereon for the public use or changes the size of any lot thereon, if any of the lots have been conveyed after the approval or recording of such plat. (See Chapter
170, Subdivision of Land.)
RETAIL STORES AND SHOPS
Buildings for display and sale of merchandise at retail or
for the rendering of personal services, but specifically exclusive
of coal, oil storage, lumberyards and contractors' storage yards.
RIGHT-OF-WAY LINES
The boundary lines of land used or intended for use as streets
and utilities and from which setbacks or front yard depths and lot
depths shall be measured.
ROADSIDE STAND
A permanent structure, together with its surrounding display
area and supporting off-street parking area, designed for the retail
sale of farm produce and located as an accessory use in accordance
with the provisions of this chapter. The intermittent sale of homegrown
produce as an accessory use not involving a building or structure,
not occupying more than 300 feet and not creating any undue traffic
hazards, shall not be deemed to constitute a roadside stand.
ROOMING HOUSE (LODGING HOUSE)
A building, other than a hotel, where lodging is provided
for three or more persons for compensation pursuant to previous arrangements
but not open to the public or transients.
SETBACK
The minimum distance by which any building or structure must
be separated from the front lot line.
SHORT-TERM RENTAL
The provision of a room or space in a dwelling that is suitable
or intended for occupancy for sleeping, or lodging purposes, for a
period of at least two consecutive days but fewer than 30 consecutive
days, in exchange for a charge for the occupancy.

SIGHT TRIANGLE EASEMENT
A triangular shaped area at the intersection of two roads
established in accordance with the requirements of the Virginia Highway
Department in which visual obstructions are prohibited in order to
promote traffic safety.
SIGN
Any display of any letter, words, numerals, figures, devices,
emblems, pictures or any parts or combinations thereof by any means
whereby the same are made visible for the purpose of making anything
known, whether such display is made on, attached to or as part of
a structure, surface or any other thing.
SIGN, AREA OF
The entire area within a circle, triangle, parallelogram
or trapezoid enclosing the extreme limits of writing, reproduction,
emblem or any figure of similar character, together with any frame
or other material or color forming an integral part of the display
or used to differentiate the sign from the background against which
it is placed, excluding the necessary supports or uprights on which
such sign is placed. On double-faced signs, only one display face
shall be measured in computing total sign area where sign faces are
parallel and are at no point more than two feet from one another.
SIGN, BUSINESS
A sign which directs attention to a business, commodity,
service, activity or product sold, conducted or offered upon the premises
where such sign is located.
SIGN, HOME OCCUPATION
A sign not exceeding two square feet in area on each side
directing attention to a product, commodity or service available on
the premises, but which product, commodity or service is clearly a
secondary use of the dwelling.
SIGN, IDENTIFICATION
A sign on the premises bearing the name of a subdivision,
the name of a group housing project or of a school, college, park,
church or other public or quasi-public facility, or a professional
or firm nameplate, but bearing information pertaining only to the
premises on which such sign is located.
SIGN, OUTDOOR ADVERTISING
Any sign of any material and any character whatsoever which
is placed (including erection, construction, posting, painting, printing,
tacking, nailing, gluing, sticking, carving or other fastening, affixing
or making visible in any manner) for outdoor advertising purposes
in any way whatsoever.
SIGN, TEMPORARY
A sign applying to a seasonal or other brief activity such
as but not limited to summer camps, horse shows, auctions or sale
of land.
SPECIAL USE PERMIT
A permit granted by Town Council, upon review and recommendation
of the Planning Commission, for a use permitted by the Council to
occupy land and/or buildings erected thereon for a specific purpose
not yet permitted by right, but in accordance with standards or conditions
and procedures included in this chapter or by the Town Council.
STATE
The Commonwealth of Virginia.
STORY
That portion of a building, other than a cellar or mezzanine,
included between the surface of any floor and the floor next above
it, or if there is no floor above it, then the space between the floor
and the ceiling next above it; a mezzanine shall be deemed a full
story when it covers more than 33% of the area of the story beneath
the mezzanine or if the vertical distance from the floor next below
it to the floor next above it is 24 feet or more.
STORY, HALF
A space under a sloping roof which has the line of intersection
of roof decking and wall face not more than three feet above the top
floor level and in which space not more than 2/3 of the floor area
is finished off for use.
STREET or ROAD
A public thoroughfare, except an alley or driveway, which
affords vehicular traffic circulation and principal means of access
to abutting property.
STREET LINE
The dividing line between a street or road right-of-way and
the contiguous property.
STRUCTURAL ALTERATION
Any change in the supporting members of a building or structure,
such as bearing walls, partitions, columns, beams or girders, or any
change in the width or number of exits or any substantial change in
the roof.
STRUCTURE, OUTDOOR ADVERTISING
Any structure of any kind or character erected or maintained
for outdoor advertising purposes, upon which any outdoor advertising
sign may be placed, including also outdoor advertising statuary.
SUBDIVISION
See the Subdivision Regulations for the Town of Stanley.
SURVEYOR, PROFESSIONAL
A licensed professional surveyor, registered in the Commonwealth
of Virginia by the Department of Professional and Occupational Regulation
as a surveyor. This term shall also include land surveyors.
SWIMMING CLUB
A public or privately owned pool open to the public, having
dressing rooms, off-street parking and other appropriate accessory
facilities.
THEATER, INDOOR
A building designed and/or used primarily for the commercial
exhibition of motion pictures to the general public or used for performance
of plays, acts, dramas by actors and/or actresses.
TOWN
The Town of Stanley, Virginia.
TOWNHOUSE
A building consisting of dwelling units arranged, designed,
intended for and occupied exclusively by one family, said building
consisting of one of a group of not less than three attached dwelling
units nor more than eight attached dwelling units. Each dwelling unit
shall be separated by an unpierced partition and contain at least
two stories and not more than 2 1/2 stories and not to exceed
35 feet in height. Each unit must also contain at least 500 square
feet from exterior wall to exterior wall, and each dwelling shall
have at least one separate entrance from the outside.
TRAILER, CAMPING
A portable vehicular structure built on a chassis as a temporary
dwelling for travel, recreation and vacation, having a body width
not exceeding eight feet and being of any length, provided that its
gross weight does not exceed 4,500 pounds, or, being of any weight,
provided that its body length does not exceed 29 feet.
USE
The purpose or activity for which land or buildings thereon
are designed or arranged or for which land or buildings are occupied
or maintained.
VARIANCE
A relaxation of the terms of this chapter where such variance
will not be contrary to the public interest and where, owing to conditions
peculiar to the property and not the result of the action of the applicant,
a literal enforcement of this chapter will work undue hardship on
the property owner. A variance is authorized only for height, area
and size of structure or size of yards and open spaces. Establishment
or expansion of a use otherwise prohibited shall not be allowed by
variance, nor shall a variance be granted because of the presence
of nonconformities in the zoning division or district or adjoining
divisions or districts, nor solely for the economic benefit of the
person requesting such variance.
WATERCOURSE
Any land area or use either naturally formed or artificially
designed for the storage, passage, retention or flow of water, including
but not limited to the following: lake, pond, canal, ditch, stream
or swale.
YARD
An open space of a generally uniform width or depth on the
same land with a building or group of buildings, where open space
lies between the building or group of buildings or other specified
points and the nearest lot line and is unoccupied and unobstructed
from the ground upward except as otherwise provided herein.
YARD, FRONT
A yard extending across the full width of the lot and lying
between the adjacent street right-of-way line and the building setback
line.
YARD, REAR
A yard extending across the full width of the lot and lying
between the rear property line of the lot and a line drawn generally
parallel to the rear lot line at such distance as may be specified
herein for any district.
YARD, SIDE
A yard between the side lot line and a line drawn generally
parallel thereto at such distance as may be specified herein for any
district and extending from the setback line to the rear yard line.
On a corner lot the side yard adjacent to a street shall extend the
full depth of every such lot.
ZONING MAP
The Official Zoning Map of the Town of Stanley, Virginia,
and all amendments thereto.
ZONING PERMIT
A permit issued by the Zoning Administrator to the applicant
before the applicant may proceed with any work affected by any provisions
of this chapter or begin any uses of land and/or structures as permitted
by this chapter.
