The Town Board of the Town of Cornwall has determined
that there is increased construction ongoing in the Town of Cornwall,
and the Town Board has determined that some of the present construction
and much of the anticipated future development of the town will involve
the installation of water mains and other water-related facilities,
and the Town Board believes that it is important for the public health,
welfare and safety of the present and future residents of the Town
of Cornwall that specifications for the installation of water mains
and water-related facilities within the Town of Cornwall, outside
of the Village of Cornwall-on-Hudson, be established, and at the request
of the Town Board the Superintendent of Public Works has presented
to the Town Board proposed specifications for the installation of
water mains and other water-related facilities which the Town Board
has found to be acceptable. Therefore, the Town Board determines that
it is in the best interests of the Town of Cornwall to enact this
article.
As used in this article, the following terms
shall have the meanings indicated:
CONTRACTOR
The individual, corporation, partnership or entity installing
the water main.
INSPECTOR
The Superintendent of Public Works of the Town of Cornwall
or his duly appointed designee, including but not limited to the Engineer
for the Town of Cornwall.
OWNER OR CONSUMER
The property owner owning the property and/or improvement
served by the water main or other water-related installation.
TOWN
The Town of Cornwall.
TOWN BOARD
The Town Board of the Town of Cornwall.
The reduced-pressure backflow preventer shall
consist of two independently operated spring-loaded poppet-guided
check valves with an automatically operating, mechanically independent,
hydraulically dependent pressure-differential relief valve located
between the two check valves. Further, there shall be two shutoff
valves and four test cocks. If either check valve should leak, the
pressure-differential relief valve shall open and discharge to the
atmosphere, thus maintaining the zone pressure less than the supply
pressure. The device shall be constructed so it can be disassembled
and repaired without removing the main body from the supply line.
This device shall be equal in all respects to the Neptune Model 575
reduced-pressure backflow preventer as marketed by the Neptune Water
Meter Company, Atlanta, Georgia.
The double check-valve assembly shall consist
of two independently operated spring-loaded poppet-guided check valves,
each holding a minimum of one pound per square inch in the direction
of flow, two shutoff valves and four test cocks. The device shall
be constructed so that it can be disassembled and repaired without
removing the main body from the line. This unit shall be equal in
all respects to the Neptune Model 550 double check-valve assembly
as marketed by the Neptune Water Meter Company, Atlanta, Georgia.
All recipients of water service shall be deemed
to have consented to the entry of town personnel onto the premises
receiving water, which said entry shall be limited to purposes of
investigation and/or repairs to the water system.

A. Purpose. It is the intent of this section to detail the responsibilities
of the Town and individual property owners regarding maintenance and
repair of service lines.
B. Responsibilities of Town. The Town shall be responsible for maintenance
and repair of the curb stop, curb box and that portion of the service
line lying in the public right-of-way.
C. Responsibilities of property owner.
(1)
The property owner shall maintain in perfect order, at his sole
cost and expense, the entire service line from the public right-of-way
to the building. Notwithstanding the foregoing, in those cases where
a curb stop exists in the public right-of-way, the property owner
shall be responsible for repairs and maintenance of that portion of
the service line between the boundary line of the public right-of-way
and the curb stop.
(2)
All leaks in that portion of the service line which the property owner must maintain and repair shall be repaired by the property owner at the property owner's sole expense. Failure to repair such leaks within 24 hours after written notice shall subject the property owner to discontinuance of water service until said repair is made. The Town shall have the right and authority to enter upon the property and make the necessary repairs and charge the cost of such repairs to the property owner. Such costs, if unpaid, shall be collected in the manner set forth in §
150-8.
(3)
In the event that a water service line freezes, the Town shall,
after notice, undertake thawing of said line. The cost of thawing
the service line shall be borne equally by the property owner and
the Town.
