As used in this chapter, the following terms shall have
the meanings indicated:
ALTERATION
Any change, rearrangement, addition or modification in construction
to any existing building.
APPROVED
The approval granted by the Department of Code Enforcement.
BASEMENT
The portion of any building located partly underground but having
less than half its clear floor-to-ceiling height below the average grade of
the adjoining ground.
BUILDING
A structure, or portion thereof, constructed and designed for permanent
and continuous occupancy for group assembly; business, industrial, institutional
or storage purposes; and the like.
CELLAR
The portion of any building having half or more than half of its
clear floor-to-ceiling height below the average grade of the adjoining ground.
CODE ENFORCEMENT OFFICER
The Code Enforcement Officer shall be an official of the Township
of Marple designated by the Board of Commissioners to assist in the enforcement
of this chapter.
CORRIDOR
A passageway, hallway or similar designation for unobstructed travel
from or through subdivided areas.
DEPARTMENT
The Department of Code Enforcement, Township of Marple.
DIRECTOR
The Director of the Department of Code Enforcement, Township of Marple.
EXIT OR EXITWAY
Any required means of direct egress in either a horizontal or vertical
direction leading to the exterior.
EXTERMINATION
The control and elimination of insects, rodents or other pests by
eliminating their harborage places; by removing or making inaccessible materials
that may serve as their food; by poisoning, spraying, fumigating or trapping;
or by any other recognized and legal pest elimination.
FIRE DOOR
A door and its assembly, so constructed and assembled in place as
to give protection against passage of fire.
FIRE WALL
A wall constructed so as to give protection against the passage of
fire.
FLOOR AREA
The area included within the surrounding walls of a building, exclusive
of vent shafts, elevator shafts, courts and fire towers.
GARBAGE
Includes offal, dead animals, decaying or putrid vegetable or organic
waste matter and all liquid substances derived therefrom.
HOTEL
Any building where persons are lodged or received for a consideration
for a single night or a longer period. This shall be meant to include "motel."
INFESTATION
The presence within or around a building of any insects, rodents
or other pests.
NURSING HOME
A building which admits persons for care, treatment or nursing by
reason of sickness, injury, infirmity or other disability.
OCCUPANCY
The purpose for which a building or part thereof is used or intended
to be used. "Change of occupancy" shall mean a change from one occupancy classification
to another and shall not be construed as meaning a change of user or occupant.
OCCUPANT
Any person, including an owner or operator, utilizing or occupying
space in a building or building unit.
OPERATOR
Any person having charge, care, management or control of any building
or part thereof, in which space or building units are let.
OWNER
Any person who, alone or jointly or severally with others:
(1)
Shall have legal title to any building or building unit, with or without
accompanying actual possession thereof; or
(2)
Shall have charge, care or control of any building or building unit,
as owner or agent of the owner or as executor, administrator, trustee or guardian
of the estate of the owner. Any such person thus representing the actual owner
shall be bound to comply with the provisions of this chapter and of the rules
and regulations adopted pursuant thereto, to the same extent as if he were
the owner.
PERSON
An individual, firm, corporation, association or partnership.
PUBLIC HALL
Any building which, or part of which, is used as a place where the
public may assemble for the purpose of entertainment or instruction or to
witness athletic contests or for other similar purposes.
REPAIR
The reconstruction or renewal of any part of an existing building
for the purpose of its maintenance.
RUBBISH
Combustible and noncombustible waste materials, except garbage.
STRUCTURE
Any piece of work which is built or constructed.
SUPPLIED
Installed, furnished or provided by the owner or operator at his
expense.
VENEER
A facing of brick, stone, concrete, tile, metal, wood, glass or the
like, attached to a wall.
WAREHOUSE
Any building used exclusively for the storage of merchandise or other
products.
