No person, partnership, firm or corporation owning or occupying land adjoining or abutting upon a village street of the Village of Sylvan Beach shall erect, construct, keep, maintain or replace a fence, guard rail, post, posts or other structure or obstruction upon the lands and premises of such person, partnership, firm or corporation at any point or place thereon beyond the edge of the street right-of-way nor within five feet of the edge of the pavement or traveled portion of any village street in the Village of Sylvan Beach, Town of Vienna, Oneida County, New York.

A person, partners, firms or corporations having said structures or obstructions prior to the effective date of this Article which are in violation of this Article that are not an interference to normal vehicular and/or pedestrian traffic and can show reasonable cause for retaining said structures or obstructions and/or unreasonable hardship caused by the removal of said structures or obstructions may, at the discretion of the Village Board, be allowed to continue as a variance to this Article.
Any person or persons erecting screening devices, shrubbery or other obstructions must conform to the following restrictions:
A. 
Screening devices must not exceed the height of four feet along the front property line or six feet along the side and/ or rear.
B. 
Screening devices must be kept free of broken parts, rotted materials, sharp metal, wood, glass or plastic shards and shall be maintained in a vertical alignment and in a structurally sound and safe condition at all times.
C. 
Screening devices may not be constructed of barbed wire or be an electrified fence, except by special permission of the Village Board, or any other materials constructed so as to constitute a hazard.
D. 
Any wire or wires used for a screening device must be clearly marked for the protection of the public.
E. 
All portions of a lot enclosed by a screening device shall be made accessible for fire-fighting purposes by the installation of appropriately located pedestrial gates not less than three feet in width. A screening device may not enclose a fire hydrant, a standpipe or any other fire-fighting device.
F. 
A screening device shall not be constructed so as to obstruct the visibility of any pedestrian or vehicular traffic traveling upon or entering or leaving any street highway of the Village of Sylvan Beach.
A. 
Any person violating any of the provisions of this Article shall be guilty of a violation and shall, upon conviction thereof, be punishable by a fine not exceeding $250 for each offense or by a term of imprisonment not to exceed 15 days, or by both such fine and imprisonment. Each day that such violation shall continue or be permitted to exist shall constitute a separate violation.[1]

B. 
Any person violating this Article shall also be subject to a civil penalty enforceable and collectible by the Village of Sylvan Beach in the amount of $50 for each such offense, such penalty to be collectible by and in the name of said village for each day that such violation shall continue.
C. 
In addition to the aforesaid penalty and punishment, the Village Board may also maintain an action or proceeding in the name of said village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this Article.
