A. 
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes any natural person, partnership, firm or corporation.
B. 
The singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine and the neuter.
It shall be unlawful for any person to conduct or hold any carnival at any place within the Borough of Leetsdale without first having obtained a permit therefor from the Mayor, as hereinafter required. Application for such permit shall be made to the Mayor and shall indicate the proposed location for such carnival; the dates on which the same is proposed to be held; the nature of the entertainment, features and attractions to be offered thereat; and the name and address of the sponsoring organization, or of the owner or operator of such carnival, if different from that of the applicant.

No such permit shall be granted until the applicant therefor shall have paid a permit fee, as established by resolution of Borough Council, which shall be for the use of the Borough, for each day or fraction thereof, on which such carnival is proposed to be held in the Borough. Provided, the Mayor shall have authority to refuse to grant any such permit where, in his opinion, such refusal shall be in the best interest of the health, morals, safety and welfare of the Borough and its inhabitants. Provided further, the Borough Council shall have the authority to direct the Mayor to waive the permit fee for any carnival held for the benefit of a civic, religious, educational or other nonprofit corporation or organization.
The Mayor shall have the authority to revoke any permit granted under this chapter when he shall deem such revocation to be in the interest of the public health, safety, welfare, or morals or for giving false information on the application for such permit. It shall be unlawful for any person to continue to operate any carnival after the permit therefor shall have been revoked or shall have expired. Any permit holder may appeal to the Borough Council from any action by the Mayor revoking his permit. No permit fee or part thereof shall be refunded to any person whose permit shall have been revoked.

Any person who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this chapter continues shall constitute a separate offense.
