This article shall be known and may be cited as the "Lower Allen Township Unapproved Right-of-Way Structures Ordinance."

A. 
It shall be unlawful for any person to construct an unapproved structure upon the Township right-of-way.
B. 
Any unapproved structures in the public right-of-way street or sidewalk constructed before the date of this ordinance shall be permitted if the owner or tenant provides an indemnification agreement to the Township on the form prescribed (Appendix A).[1]

C. 
Mailboxes.

(1) 
Mailboxes located in the right-of-way must be installed to the U.S. Postal Service specifications contained in Appendix B.[2] Additionally, there must be at least 36 inches of clear zone under the mailbox support arm, as measured from the road surface.

(2) 
During winter maintenance operations, if a mailbox is hit by a plow, the Township will replace it with a standard four-inch by four-inch wooden post and standard polyvinyl chloride (PVC) mailbox.
(3) 
The Township will not replace ornamental or decorative fixtures.
(4) 
The Township will only replace the mailbox if it is contacted by the truck or plow itself.
(5) 
The Township will not replace mailboxes not installed in accordance with the specifications in § 187-58C(1).
