No person shall deposit, throw, spill or dump dirt, mud, gravel, sand, stone, cement, trees, stumps, brush, grass, wood, metal, iron, plastic, manure, fertilizer, ashes, coal, cinders, refuse, garbage or any other material upon any street or portion thereof or upon public or private lands in the vicinity thereof without permission of the owner or cause or permit the same to be done.
For purposes of this Article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
ASHES AND REFUSE MATTER
The residue of any material used as fuel for heating or cooking purposes after combustion has taken place, broken or discarded crockery, glassware, rags, bottles, tin cans, lawn and garden clippings, weeds and discarded shrubbery but not building material or fixtures, earth, stones or industrial waste.
GARBAGE
The refuse of animal and vegetable matter which has been used as food, and all other household matter, exclusive of ashes and refuse matter as herein defined.
SCAVENGER
A person who collects and travels by foot, automotive device or other method of conveyance from place to place, from house to house, from apartment to apartment or from street to street on singular or multiple occasions each in the business of collecting, buying and selling or delivering old rope, iron, brass, tin, copper, lead, steel, metal wood products, rags, glass, glass products, paper or paper products or any discarded material of any kind, ashes, refuse matter and garbage.[1]

No person shall collect, remove or in any way interfere with ashes, garbage or other refuse matter from any dwelling house, tenement, store or other building or place or engage in the business or occupation of gathering, collecting or removing ashes, garbage or other refuse matter within the borough or use the streets of the borough for the purpose of transporting refuse matter, unless he first procures a license therefor from the Council.
An applicant for a scavenger license shall, at the time the application is filed, furnish the Council with information setting forth his previous experience in scavenger service, the type of equipment available and his financial ability to carry on a proper scavenger service covering the entire borough or such part thereof as the Council may require. The applicant shall submit satisfactory evidence that the place of disposal for ashes, garbage and other refuse matter collected is located in a proper place approved by and satisfactory to the Council and that such site for disposal is available and guaranteed for the period of the license. The applicant shall also furnish satisfactory evidence of good character and dependability. An application for license and renewals thereof shall be filed on or before the first day of November each year.
Upon approval of an application for a scavenger license, the license shall be issued upon payment of a license fee of $200, for purposes of revenue, to the Borough Treasurer for the use of the borough. Each license issued under this Article shall expire on December 31 in each year.
Any license granted to a licensee under this Article who violates any provision of this Article may be revoked by the Council for sufficient cause and after notice and hearing. Such revocation shall be in addition to the penalties provided in this Article.
A. 
The licensee shall collect and transport ashes, garbage and other refuse matter in motor-driven trucks equipped with sound and tight bodies to prevent liquid matter from dripping onto the street. All vehicles furnished and used shall be subject to the approval of the Sanitary Inspector of the Board of Health at all times. Vehicles shall be maintained in good working order and in a clean and sanitary condition. The licensee shall furnish a sufficient number of trucks of ample power and capacity to carry out the collection services. Truck bodies shall be completely covered with a heavy covering during transportation from collection to disposal points.
B. 
Any material which spills off the truck during loading or transporting shall be broomed up immediately so as to leave the premises or streets in as clean a condition as theretofore. Failure to do so will be considered a violation of this Article.
C. 
The licensee shall notify all persons desiring scavenger service of the days upon which collections will be made and the rates to be charged therefor.
D. 
All ashes, garbage and other refuse matter shall be collected promptly, transported and disposed of by the licensee in the manner prescribed without any liability whatever on the part of the borough. All matter so collected shall be deposited in the disposal site on the day it is collected.
E. 
Collections shall be made from the premises of persons desiring scavenger service within the borough or, if requested by said persons, collection shall be made from buildings located upon the lot or land of such persons upon which the premises are erected, regardless of the locations of such buildings with respect to the public street or highway.
F. 
All collections shall be made at least twice weekly.
G. 
The licensee shall maintain a telephone connection with a competent person in attendance to receive and transmit to operators of the scavenger service complaints, notices and directions from the Sanitary Inspector and to see that such complaints, notices and directions receive prompt and proper attention.
Scavenger service licensed under this Article shall be subject to the supervision of the Sanitary Inspector and pursuant to further rules and regulations drawn up by him from time to time and approved by the Council. Such approval may be by resolution.
The fees for scavenger service charged by a person licensed hereunder shall be reasonable and in accordance with the value of the services rendered.
It shall be the duty of the licensee, subject to the provisions of this Article as to the number of collections, whenever requested by any person within the borough, to call for, remove or carry away from any dwelling, store, tenement building or other place all ashes, garbage and other refuse matter which may be placed in receptacles suitable for removal. No licensed scavenger or person employed under his authority shall neglect or refuse to remove any such material which has been placed in receptacles for removal.
The Sanitary Inspector of the Board of Health shall act as the agent of the Council to supervise and enforce the provisions of this Article and all rules and regulations relating thereto. The Council, by resolution, may designate any other borough employee to perform the duties herein delegated to the Sanitary Inspector.
