It shall be unlawful for any person to operate any type of motorcycle
or motorized bicycle, including but not limited to minibikes, trail bikes,
motor scooters, four-wheeled motor vehicles commonly known as "go-carts,"
and motorized bicycles commonly known as "mopeds," upon any Borough-owned
land, or Borough-managed land, or Board of Education land in the Borough of
Paulsboro, except in properly designated and marked parking areas.
A. The applicable areas shall include but are not limited
to the Borough athletic complex at Mantua Avenue and Second Street; the Borough
park at the Delaware River; and certain real property upon which the Paulsboro
public school structures are situate.
B. Operation of said motorcycles and motorized bicycles
shall be limited to parking areas upon Borough-owned, Borough-managed and
Board of Education real property. Said parking areas shall be marked and designated
by conspicuously displayed signs located in at least two places upon each
parcel of said property.
C. Specifically restricted for use regardless of signs and
posting are the fenced-in playing fields, including baseball or football fields,
at the Borough athletic complex at Mantua Avenue and Second Street, which
property is defined as one parcel owned in part by the Borough of Paulsboro
and owned in part by the Department of the Interior, Bureau of Outdoor Recreation,
and Borough-managed.
It shall be unlawful to operate any motorcycle or motorized bicycle,
in such a careless, reckless or negligent manner upon the real property defined
in this ordinance so as to endanger the safety of any person or the property
of any person.
It shall not be unlawful for any employee, agent or officer of the Borough
or Board of Education to operate a motor vehicle, motocycle, motor-driven
vehicle or motorized bicycle, upon said real property for the purpose of maintaining,
repairing or doing any public work within the scope of his employment or agency.
Any person over the age of 18 years who has violated any provision of
this ordinance and has been convicted of a violation by a court of competent
jurisdiction, shall be sentenced to a fine of not less than $15 nor more than
$150 or to imprisonment for a term not exceeding 10 days, or both.
Any person under the age of 18 years who has violated any provision
of this ordinance, and who has been convicted of a violation of this ordinance
by a court of competent jurisdiction, shall be sentenced to make full restitution
for any and all damage and injury to all property damaged and injured. Said
minor person shall be subject further to whatever sentence the said court
deems equitable and just.
Should any section or portion of this ordinance be held to be illegal
or unconstitutional by any court of competent jurisdiction, said section or
portion thereof shall be severed, and the remaining portions of this ordinance
shall remain in full force and effect.
This ordinance shall take effect immediately upon passage and publication
and approval by the State of New Jersey Department of Transportation as provided
by law.
