Whatever is dangerous to human life or to the
health, and whatever renders the ground, air, food or water unwholesome
and injurious to human health, also uncomfortable and obnoxious, is
hereby declared to be a nuisance and is prohibited.

Nuisance provisions of this article affect the health, safety,
welfare and general quality of life of the community. This article
shall be administered by the Borough's Code Enforcement Office, the
Borough's Police Department or the Gloucester County Health Department.

The casting, throwing, draining or discharging or causing to
be cast, thrown, drained or discharged, into any public street or
highway, gutter, alley or other public place or private grounds within
the Borough of Paulsboro, any slops, swill, filth, animal or human
excrement, shall be deemed and is hereby declared to be a nuisance;
and all ponds, pools or collections of still and stagnant water or
filth of any kind, any accumulation or deposit of offal or of decaying
animal or vegetable substances in or upon any lot of land near any
inhabited dwelling house or in any public street or highway, alley
or other public or private place within the limits of the Borough
of Paulsboro, is declared to be a nuisance, and every person creating
or maintaining or aiding in the creation or maintenance of any such
nuisance shall forfeit and pay a penalty not exceeding $100 for each
such offense, and in case of a continuing offense, shall be liable
to a further penalty of $50 for each day after written notice from
the Borough or the Gloucester County Department of Health.

Other nuisances within this Borough are hereby defined and declared
to be, and they shall include and embrace, the placing or depositing
in or upon any street or alley or in or upon any public or private
property any dead animal or any part of the same, or animal or human
excrement or filth from privies or cesspools or catch basins, or garbage;
also any foul or offensive or obnoxious matter or substances whatever;
also any full or overflowing privy vault, cesspool or other receptacle
for filth; also permitting any liquid or solid matter taken from cesspools
or privy vaults to be deposited in or upon any lawn, lot or place
within the limits of the Borough of Paulsboro and left exposed; also
allowing any night soil, swill or other offensive or decomposing solid
or fluid matter or substances to leak or ooze from any cart or wagon
or vessel in which the same may be conveyed or carried. Every nuisance
as above defined is hereby prohibited and forbidden within the limits
of the Borough of Paulsboro, and any person making, causing, maintaining
or permitting any of said nuisances shall forfeit and pay a penalty
not exceeding $100 for each such offense.

No animal or vegetable substance or swill or garbage, nor any
offensive material, either separately or mixed with ashes or rubbish,
shall be deposited on, used to fill in or raise the surface level
of any ground, lot or street, nor shall any person maintain any sunken
land from which there shall arise any offensive gases deleterious
to health. Any person or persons offending against any of the provisions
of this section shall forfeit and pay a penalty not exceeding $100
for each and every offense.

All owners of real estate in the Borough of Paulsboro shall
keep the same free and clear of all noxious weeds and other unhealthy
vegetable growth, and it shall be the duty of the Code Enforcement
Officer, Borough Police or Gloucester County Board of Health to give
written notice to each and every person owning such real estate in
the Borough of Paulsboro wherein such noxious or unhealthy vegetable
growth is permitted to remain and exist, notifying such person that
if the same is not cut down and removed within three days from the
date of such notice, then and in such case the Board of Health will
cause the same to be cut down and removed at the expense of the owner
or owners of any such real estate and in case any such owner or owners
shall not reside in the Borough of Paulsboro, then and in such case
the said notice shall be mailed with postage prepaid thereon by the
Code Enforcement Officer, Borough Police or Gloucester County Board
of Health, to the respective post office address of such owner, if
the same can be ascertained, and, if not, be posted upon the premises,
and it shall be unlawful for any such owner or owners of any real
estate in the Borough of Paulsboro to allow or permit noxious weeds
or other unhealthy vegetable growth to grow, remain or exist thereon
after the receipt or posting of such notice. Any person or corporation
violating any of the provisions of this section shall forfeit and
pay a penalty of not less than $100 for the first offense and not
less than $200 nor more than $1,000 for subsequent offenses. Each
and every violation shall count as a separate offense.

Any imperfect trap, sink or water closet within any house, or
any other drainage appliance or fixtures within any house, from which
there shall arise any foul or obnoxious gas or odor detrimental to
human health, is hereby declared a nuisance, and any owner of said
property or other person maintaining any such nuisance, or any person
who shall refuse or neglect to repair or make perfect any defect in
any drainage appliance or any part of the soil pipe, or any fixture,
sink basin, water closet or trap attached to said waste pipe or soil
pipe, shall forfeit and pay a penalty not exceeding $100 for each
such offense.

No person or persons, corporation or corporations shall carry
on any trade or business within the limits of the Borough of Paulsboro
which may be attended by offensive or unhealthy odors and which may
be obnoxious to the inhabitants of said Borough, under a penalty of
not exceeding $100 for the first offense and a further penalty of
$50 for each day such business shall be carried on thereafter.

The operation or maintenance of any slaughterhouse or place
where cattle, sheep or swine are slaughtered or killed, or the operation
or maintenance of any tannery or place where the hides or skins of
any animals are dried, treated or tanned, within the limits of the
Borough of Paulsboro, is hereby defined and declared to be a nuisance,
and any person or persons violating or offending against any of the
provisions hereof shall forfeit and pay a penalty of $100 for each
offense, and shall forfeit and pay an additional penalty of $50 for
each and every day during which such slaughterhouse or tannery shall
continue to be operated or maintained after the first violation or
offense.

It shall be the duty of any owner, tenant, lessee or occupant
of any lot, ground, building, house or stable within the limits of
the Borough of Paulsboro, upon notice from the Code Enforcement Officer,
Borough Police or Gloucester County Board of Health, to forthwith
remove therefrom any rubbish, garbage, offal or any offensive matter
or thing, and it shall be the duty of any person, on notice from the
Code Enforcement Officer, Borough Police or Gloucester County Board
of Health to abate any nuisance existing on any premises of which
he may be the lessee, owner, tenant or occupant. If any person shall
neglect or refuse to remove any foul or obnoxious or hurtful matter
or thing or if any person shall refuse or neglect to abate any nuisances,
then the Code Enforcement Officer, Borough Police or Gloucester County
Board of Health, may proceed under the provisions of law and Paulsboro
Ordinance, and shall remove said nuisance, source of foulness or cause
of sickness and shall recover by action of debt the expense incurred
by the Borough or the Gloucester County Board of Health by such removal.
Any person or persons offending against any of the provisions of this
section shall forfeit and pay a penalty of not exceeding $250 for
each and every offense.

No person owning, occupying or having in charge any stable,
house or other premises within the limits of the Borough of Paulsboro
shall keep, have or allow thereon any dog, cat, bird or other animal
which shall by noise disturb the quiet or repose of anyone thereon
or in the vicinity, nor shall the unnecessary blowing of steam whistles
or the unnecessary ringing of bells be permitted in the Borough, and
any person offending against any of the provisions of this section
shall forfeit and pay a penalty not exceeding $100 for each such offense.

No person shall keep or allow to be kept in any building or
premises or on any ground of which he may be the owner, lessee, tenant
or occupant, within the limits of the Borough of Paulsboro, any horses,
mules or other draft animals; cows or other cattle; goats, lamb, or
other sheep; llamas, alpacas or other such animals; fowls, including
but not limited to chickens, ducks, or geese; pigs or swine; and peacocks,
emus or ostriches without a permit from this Borough, and no animals
shall be kept in any place in which the water, ventilation, drainage
and food are not sufficient and wholesome for the preservation, health
and safe condition of said animal, and every person shall cause any
establishment where animals are to be at all times in a clean and
wholesome condition and shall not allow any animal to be therein while
infected with any contagious or infectious disease, and if such contagious
or infectious disease shall exist, the owner or occupant shall notify
the Gloucester County Board of Health within 24 hours. Any person
offending against any of the provisions of this section shall forfeit
and pay a penalty of $500 for each such offense.

No person shall keep or allow to be kept in any dwelling house
or building inhabited by human beings, or any part thereof, any horses,
cattle, swine, goats or fowl. Any person offending against the provisions
of this section shall forfeit and pay a penalty of $250 for each such
offense. Subsequent offenses shall be subject to a fine not to exceed
$1,000.

A. No person shall keep a greater number of cows or other cattle, swine
or goats on any premises than is stated in the permit granted such
person by the Code Enforcement Officer, Zoning Officer and/or the
Land Use Board. The number of animals shall be based on lot size;
a minimum of one-acre lot per cow, cattle, swine or goat.
B. Any person offending against the provisions of this section shall
forfeit and pay a penalty of $500 for each such offense.

All sunken lots or marshlands where stagnant
water emits any impure or miasmatic atmosphere, or lots below grade,
shall be filled up with fresh earth, ashes or cinders by the owner
thereof when directed so to do by the Health Officer, under the penalty
not exceeding $100 for each such offense.

Every owner or lessee of any stall, stable,
shed, barn or compartment wherein any horse, cattle or swine shall
be kept shall keep and maintain suitably covered watertight boxes,
pits or vaults into which shall be placed all manure or refuse from
such horses, mules or other draft animals, cattle or swine, and such
manure or refuse shall not be allowed to collect in such stall, stable,
shed, barn or compartment or on the ground outside of said boxes,
pits or vaults in such a manner as to be offensive, and if in the
judgment of the Health Officer or any member of this Board it shall
be deemed necessary for the public health or comfort that such manure
or refuse shall be removed at night, he may prohibit said removal
between the hours of 6:00 a.m. and 10:00 p.m., and may order carts,
wagons or other vehicles transporting or carrying manure or refuse
to be provided with proper cover, and any person offending against
the provisions of this section shall forfeit and pay a penalty not
exceeding $100 for each such offense.

Any building, section or part thereof, or cellar
thereof, which is not provided with adequate means of ingress and
egress or is not sufficiently supported, ventilated, sewered, drained,
cleaned or lighted, and whatever renders the air, food or water unwholesome,
and in fact whatever is dangerous to human life or health, is hereby
declared to be a nuisance and is prohibited. Any person or persons
who shall aid in creating or contributing to the same and shall continue
to retain or maintain any of them shall forfeit and pay a penalty
not exceeding $100 for each such offense.

No person shall place or throw on any street,
road or sidewalk within the limits of the Borough of Paulsboro any
bottle, broken glass, crockery ware, iron, tin, wire or other material
or things dangerous to the life and limb of man and beast; and any
person or persons offending against the provisions of this section
shall forfeit and pay a penalty not exceeding $100 for each such offense.

No person shall burn any paper, rubbish, trash
or other article within 50 feet of a dwelling house, living quarters
or residence of any neighbor or neighbors unless the same be burned
in a properly constructed incinerator, and it shall be unlawful to
burn or attempt to burn garbage, swill, offal, old rags or other slow-burning
material which shall emit odors which render the air unwholesome and
in fact injurious to public health. Any violation of this section
is declared to be a nuisance and is prohibited. Any person or persons
offending against any of the provisions of this section shall forfeit
and pay a penalty not exceeding $100 for each such offense.

No person shall allow any ducks, geese, fowl,
cattle, swine or goats to run at large in the Borough, and no person
shall keep or permit to be kept any fowl, geese, pigs, swine or goats
except the keeping of fowl, as hereinafter provided. Any person offending
against any provision of this section shall forfeit and pay a penalty
not exceeding $100 for each such offense.

All houses, buildings or enclosures wherein
chickens or fowl are confined within the Borough limits of the Borough
of Paulsboro must be kept clean and free from all foul odors, and
all such houses or enclosures must not be situate within 50 feet of
a dwelling house, living quarters or residence of any neighbor or
neighbors. Any person or persons offending against the provisions
of this section shall forfeit and pay a penalty not exceeding $100
for each such offense.

It shall be unlawful and shall constitute a
nuisance for any person to spit or expectorate upon the sidewalks
or in any public buildings or hotel or in any streetcar or public
conveyance within the limits of the Borough of Paulsboro. Any person
or persons offending against the provisions of this section shall
forfeit and pay a penalty not exceeding $100 for each such offense.
It shall be the duty of every owner, tenant,
agent, lessee or occupant of any building to provide for or cause
to be provided and kept suitable covered, watertight boxes, barrels
or tubs for receiving and holding all the ashes, rubbish, swill or
garbage that may accumulate or be collected in said building, and
such boxes, barrels or tubs shall be placed on the sidewalk along
the curb in front of said building at regular intervals and at such
times as the Supervisor of the Streets and Highways may direct, but
nothing in this section shall prevent private parties from removing
or collecting swill or garbage if properly closed wagons or receptacles
are used. Any person or persons offending against the provisions of
this section shall forfeit and pay a penalty of $10 for each such
offense.
Every butcher and every person owning, leasing
or occupying any place, room or building, stall, store or stable or
market where fowl, swine, fish or cattle may be held or kept shall
keep such place, room, stall, store, building or market and their
yards and appurtenances thoroughly cleaned and purified, and all offal,
blood, fat, garbage, refuse and unwholesome meat shall be removed
therefrom at least once in every 24 hours after the use thereof for
any of the purposes herein referred to, under a penalty of $25 for
each and every offense.
No person shall engage in the business of collecting
and transporting kitchen garbage, swill and offal in this Borough
without obtaining a permit so to do from the Board of Health, said
permit to be procured from the Secretary, who shall pass upon the
style and character of the vehicle used for that purpose. A fee of
$1 shall be charged for issuing every such permit.
All vehicles for removing such refuse matter
made and accumulated in and about dwelling houses and other buildings
in the Borough of Paulsboro shall be watertight and securely covered
on top, and shall have permanently painted on both sides of the wagon
the name of the licensee and the number of his license.
No ashes or rubbish shall be placed in the same
receptacle containing the garbage, swill or offal, and all containers
for garbage, swill or offal shall be made of metal.

Any person or persons committing an offense
against any of the provisions of the last three sections shall forfeit
and pay a penalty of not exceeding $100 for each offense.

Any person or persons who shall maintain, conduct
or operate a saloon or place dispensing alcoholic beverages shall
keep such building or premises in a clean and wholesome condition,
and shall also provide and effect special care, disinfecting and cleansing
of bottles, glasses, coil boxes and any and all other beverage containers.
Any person or persons committing an offense against any of the provisions
of this section shall forfeit and pay a penalty not exceeding $100
for each such offense.
It shall be the duty of the Health Officer to
look after and report on all violations of this ordinance and to make
complaint against all persons so violating this ordinance.

The following shall be unlawful within the Borough
of Paulsboro:
A. To erect, maintain or have any awning, sign or other
property so as to extend over any sidewalk or street within six feet
of the ground.
B. To obstruct any sidewalk by the use of signs, boxes,
baskets, containers or other matters or things, in such way or manner
as not to leave a clear space of sidewalk the width of seven feet,
measuring back from the curbline, except on Broad Street, on which
street there shall be a clear space of sidewalk the width of 11 feet,
measuring back from the curbline.
C. To display for sale on any of the sidewalks of the
Borough any meats, vegetables or other foodstuffs.
D. To make or cause to be made, or to use any horn, whistle,
bell or other device which makes, any annoying, unreasonable and unnecessary
noise.
E. To permit, by the owner or occupant of any land, grass
or weeds to be grown over or on the sidewalks in front of any property
to a height greater than 12 inches.
F. To keep or maintain on any premises any trash, paper
or rubbish of any kind or character, in such a way or manner as to
be ignited or in such manner as to be detrimental to the public health
or safety or in such way as to be distributed by the wind to the public
streets and highways or to the property of another, or to place or
pile any trash, papers or rubbish of any kind or character along the
property line or against any fence or building.
G. To park any automobile on any of the streets or highways
of the Borough of Paulsboro during the whole or greater part of any
day or night.
H. To use or operate or cause to be used or operated
any mechanical device, apparatus or instrument for the intensification
of the human voice or of any sound or noise in any private or public
place, in such manner that the peace and good order of the neighborhood
is disturbed.
I. To play baseball, football or any other games on any
of the sidewalks, streets or highways of the Borough of Paulsboro.
J. To obstruct any sidewalk, street or highway during
any building operation without sufficiently guarding the public from
injury from said obstructions or without guarding said obstructions
at night by a sufficient number of red lights to properly mark the
same.
K. Smoking,
as defined in N.J.S.A. 26:3D-57, and the use of smokeless tobacco,
including chewing tobacco, use of electronic smoking devices, and
including vaping and vaping products, or any other matter or substance
which contains tobacco or any other matter that can be smoked, or
the inhaling or exhaling of smoke or vapor from an electronic smoking
device shall be prohibited in all locations identified pursuant to
the New Jersey Smoke-Free Air Act, N.J.S.A. 26:3D-55 et seq., in addition
to any and all publicly owned property within the Borough.

Any person or persons, firm
or corporation violating any of the provisions of this chapter shall,
upon conviction for each offense, be subject to a fine of not exceeding
$100 or imprisonment in the Borough or county jail for a period not
exceeding 30 days, or both, in the discretion of the Mayor, Municipal
Court or other Magistrate before whom the conviction is had.
All fines collected under this ordinance shall
be paid to the Borough Treasurer for the use of the Borough of Paulsboro.
