Unless another penalty is required to be imposed by any section of N.J.S.A. 4:19-1 et seq., any person adjudged guilty of a violation of the provisions of Article I of this chapter shall, upon conviction thereof in the Municipal Court of Somers Point, be subject to a fine of not more than $1,000, or community service for a period not exceeding 90 days, or any combination of the foregoing. The Municipal Court of the City of Somers Point shall have jurisdiction over such offenses.
In the event, however, that the violation arises out of the failure
to obtain a license and the dog subject to the license requirement
is not an attack dog, guard dog, or a dog declared by the Municipal
Court to be vicious or potentially dangerous, and the alleged violator
obtains the required license after receiving a court summons, but
prior to the initially scheduled hearing date, the penalty shall be
the minimum fine of $50, which may be payable without the necessity
of making a court appearance.
Any person found to have committed a second violation of the same or any other provision of Article II of this chapter shall be punished by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days, or by community service not to exceed 90 days, or any combination thereof, in the discretion of the Municipal Court.
Each day that a violation of Article I or Article II of this chapter exists shall constitute a separate offense.
Notwithstanding the penalties described herein for violations of
this chapter, the municipality shall be entitled to pursue any other
remedies available in law or in equity to enforce the provisions hereof
and to protect the citizens of the City.
The provisions of this chapter shall not in any way be deemed to
hinder or prohibit prosecution of violators pursuant to state law,
and the penalties and provisions of state law are deemed to be in
addition to the penalties and provisions of this chapter.
