As used in this article, the following term
shall have the meaning indicated:
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other
matter or substance which contains tobacco.

The Township of Stafford, in accordance with
N.J.S.A. 40:48-1 and N.J.S.A. 40:48-2, deems it in the public interest
to prohibit smoking in public school buildings and on public school
grounds located within the Township except as part of a classroom
instruction or a theatrical production.
Any school board having a public school building
located within the Township shall make and enforce regulations to
prohibit the smoking of tobacco anywhere in its buildings except as
part of a classroom instruction or theatrical production. The regulations
shall also provide for additional specified limitations regarding
smoking on the school grounds as designated by the school administration.
The Superintendent, or his designee of the school
district, may sign a complaint against any individual for violation
of the provisions of this article.
Every public entrance to a school shall be posted,
by the person who has control of the building, with a sign indicating
that smoking is prohibited in the building. The sign may also indicate
that violators are subject to a fine. Every sign required by this
article shall be located so as to be clearly visible to the public
and shall contain letters or a symbol which contrast in color with
the sign.
Any person who smokes in violation of this article
except as part of a classroom instruction or a theatrical production
shall be subject to a fine not to exceed $100 or by community service
not to exceed three days or any combination of fine and community
service as determined in the discretion of the Municipal Court Judge.

The Township of Stafford, in accordance with
N.J.S.A. 40:48-1 and N.J.S.A. 40:48-2, deems it in the public interest
to prohibit smoking in all Township parks, playgrounds and recreational
areas.
Notice of such prohibition shall be conspicuously
posted by sign stating "No Smoking Permitted Beyond This Point" and
shall reference the applicable Code provision herein.
Any person violating or failing to comply with
any provisions of this article shall, upon conviction thereof, be
punishable by a fine of not more than $200, by imprisonment for a
term not to exceed 90 days, or by community service of not more than
90 days, or any combination of fine, imprisonment and community service
as determined in the discretion of the Municipal Court Judge. The
continuation of such violation for each successive day shall constitute
a separate offense, and the person or persons allowing or permitting
the continuation of the violation may be punished as provided above
for each separate offense.
