As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes one or more persons of either sex, natural persons, corporations, partnership, associations, joint-stock companies and all other entities of any kind capable of being.
It shall be unlawful for any person to keep or deposit or to cause or permit to be kept or deposited ashes, smoldering coal or embers, greasy or oily substances or other matter liable to create spontaneous ignition within 10 feet of any wooden or plastered wall, partition, fence, floor, sidewalk, lumber, hay, shavings, rubbish or other combustible materials, except in metallic or other noncombustible receptacles or storage places. Such receptacles shall be placed on noncombustible stands, unless resting on a noncombustible floor or on the ground outside a building, and must always be kept at least two feet distant from any combustible wall or partition.
It shall be unlawful for any person to permit longer than 48 hours upon the roof or in any part of any building or in any courtyard, vacant lot or open space any accumulation of wastepaper, litter or combustible or flammable waste or rubbish of any kind. Every person making, using, storing or having charge of or control of any shavings, excelsior, rubbish, sacks, bags, litter, hay, straw or combustible trash, waste or fragments shall at the close of each day cause all such material which is not compactly baled and stacked in an orderly manner to be removed from the premises and stored in suitable vaults or in metal or metal-lined and covered receptacles or bins. Suitable presses shall be installed in stores, apartment buildings, factories and similar places where accumulations of paper and/or waste materials are not removed at least once every second day.
It shall be unlawful for any person without a written permit from the Chief of the Fire Department to store or cause or permit to be stored empty packing cases, boxes, barrels or other similar combustible containers, except in the open; such storage shall not be more than 20 feet in height and shall be at least 20 feet from the nearest building, unless the wall of the nearest building is blank or has its openings protected, in which case storage may be five feet from the nearest building and in a compact and orderly manner. This section shall not apply to the storage, within a manufacturing or other establishment, of sufficient packing cases, boxes, barrels or other similar containers properly to carry on its operation, but such storage shall be orderly and so located as not to endanger entrance or exit from the building.
It shall be unlawful for any person to use or cause or permit to be used cotton batting, straw, dry vines, leaves, trees, celluloid or other highly flammable material for decorative purposes in show windows or stores without a written permit of the Chief of the Fire Department. Electric light bulbs in stores, public halls or other places of public assemblage shall not be decorated with paper or other combustible materials unless such materials shall first have been rendered fireproof. Nothing in this section shall be held to prohibit the display of salable goods permitted and offered for sale in the store.
It shall be unlawful for any person to take or cause or permit to be taken an open flame into any building, barn, vessel or boat or other place where highly flammable, combustible or explosive material is kept, unless such light or flame is well secured in a glass globe, wire mesh cage or similar approved light.
It shall be unlawful for any person to use or cause or permit to be used any heating apparatus with an open flame or any artificial lighting system other than incandescent electric lights in any warehouse for the storage of rags, excelsior, hair or other flammable or combustible material or in any shop or factory used for the manufacture, repair or renovating of mattresses or bedding or for the upholstery of furniture.
It shall be unlawful for any person to throw from any building a lighted cigar or cigarette or anything that is on fire so that the same will fall over or upon an awning or the street, sidewalk or property adjacent thereto, provided that this section shall not apply to any person throwing from windows the contents of a building which is on fire.

Outdoor burning in the Village of Hudson Falls is governed by Chapter 142 of the Code.
The Fire Chief shall have full power and it shall be his duty to enforce all provisions of this chapter and to approve devices and types of receptacles or containers herein specified.

Any person who, himself or itself or by his or its agent or employee, violates any of the provisions of this chapter or any order or regulation given pursuant thereto shall, upon conviction thereof, be subject to a fine not exceeding $250 or imprisonment for a period not exceeding 15 days, or both, for conviction of a first offense; for conviction of a second offense, both of which were committed within a period of three years, punishable by a fine of not less than $250 nor more than $500 or imprisonment for a period not to exceed 30 days, or both; and upon conviction for a third offense or subsequent offense, all of which were committed within a period of five years, punishable by a fine of not less than $500 nor more than $750 or imprisonment for a period not to exceed 60 days, or both. Each day on which such violation continues shall constitute a separate offense.
