Every retail business within the Borough of Emerson shall be closed to the public, and business with the public therein shall be and is hereby prohibited, after the hour of 12:00 midnight and before the hour of 7:00 a.m. of any day. The provisions of this section shall not apply as specified in § 124-2, nor shall they apply to pharmacies for the purposes of filling prescriptions or to restaurants whose primary purpose is the sale at retail of prepared meals or food and/or beverages for consumption upon the premises of such restaurants, nor shall it apply to premises whose primary business is the sale of alcoholic beverages for on-premises consumption, whose hours are regulated by statutes of the State of New Jersey and other ordinances of the Borough of Emerson.
No gas station, deli or coffee shop within the Borough of Emerson shall be permitted to be open to conduct business after the hour of 12:00 midnight nor before the hour of 6:00 a.m.
Any person, partnership, corporation or other entity found to be operating a retail business within the Borough of Emerson in violation of this chapter shall, upon conviction, be subject to a penalty of not more than $1,000.
