Where a Commissioner desires to raise a legal question about a fellow
Commissioner with the Solicitor, he may do so by addressing his question directly
to the Township Solicitor. The Township Solicitor will notify the Commissioner
about whom the question is asked of the nature of the question and give that
Commissioner an opportunity to respond. Upon receiving such a response or
allowing an adequate time therefor, the Solicitor shall respond to the question
in writing, without any further authorization from the Board of Commissioners.
Where a township official or employee, other than a Commissioner, has
a question about the legal status of a specific township official or employee
or specific group of township officials or employees, the township official
or employee shall refer this question to the Commissioner who is responsible
for the questioner's area of concern. That Commissioner shall bring this
issue before the Board, who shall take formal action on whether or not to
refer this matter to the Township Solicitor.
Any legal questions not directly relating to a specific Commissioner,
official or employee may be directed by a Commissioner, official or employee
directly to the Township Solicitor, who shall respond without further authorization
of the Board.
