Shade trees may hereafter be planted between the curb and the sidewalk only where the distance between curb and sidewalk is at least 18 inches and only upon the approval of the Department of Public Works. Such trees shall be under the supervision of the Department of Public Works and shall be trimmed by the owners of the adjoining lots so that no part thereof shall extend onto or over any sidewalk at a height of less than eight feet above the surface thereof. Any such tree shall be removed at the expense of the owner of the adjoining lot as soon as such tree shall cause any damage to the curb or sidewalk or shall damage or interfere with any sewer or sewage disposal or with the proper flow of surface or stormwater.

Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 and not more than $1,000 for each offense, together with the costs of prosecution, or to imprisonment for not more than 30 days, or both; provided that each day's violation of any of the provisions of this article shall constitute a separate offense.

After the passage of this article, it shall be unlawful for any person or corporation to permit or foster the growing of trees or shrubberies or to plant trees or shrubberies or to permit trees or shrubberies to stand when the same, upon investigation by the borough officials of the Borough of Trafford, are found to damage or interfere with the sewers or sewage disposal or the proper flow and disposal of surface water or stormwater in the Borough of Trafford, whether said damage or interference is from the roots of said trees or shrubbery or from the trunk, branches or leaves of said trees or shrubberies. If any such trees or shrubberies are discovered and are found to interfere with the sewage or the proper flow of surface or stormwater or found to interfere with sewer pipes or sewer lines, the proper borough official or officials of the Borough of Trafford shall notify either the lessee or the owner, or both, of the property on which said trees or shrubberies are located to remove said trees or shrubberies within 30 days from the time said written notice is served upon said lessee or owner, or both; and upon failure to do so, said lessee or owner, or both, shall be subjected to penalties as hereinafter stated, and each day of violation shall constitute a distinct and separate offense.

Any person or persons, firm or corporation violating any of the provisions of this article shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not less than $100 nor more than $1,000 and costs of prosecution, or to imprisonment for not more than 30 days, or both; provided that each day's continuance of a violation of any of the provisions of this article shall constitute a separate offense.
