The Town of Tolland, pursuant to the provisions of Section 7-246 of
the Connecticut General Statutes, hereby designates its legislative body,
the Town Council, as the Sewer Authority, together with such powers as are
granted by the Connecticut Statutes, as amended.
The Town of Tolland, pursuant to Section
C4-4 of the Tolland Charter, hereby creates the Commission on Water and Waste Management.
The Town Council shall appoint a Commission on Water and Waste Management
consisting of nine members. Eight members shall have alternate terms of four
years, and one member shall have a term of two years. Biennially thereafter,
the Council shall appoint five members, four members to four-year terms and
one member to a two-year term, to succeed the members whose terms expire.
The Commission on Water and Waste Management shall be an official and
continuing agency of Town government acting for and under the jurisdiction
of the Town Council in dealing with matters related to community water supplies,
domestic and commercial sewage handling systems, solid waste disposal and
air and water pollution. It shall make or cause to be made studies or use
other information-gathering methods as the basis for recommendations to the
Town Council as to the proper action for dealing with problems within its
purview. It shall hold regular meetings and public hearings as necessary and
conduct its affairs in accordance with all statutes and Town ordinances dealing
with the keeping of records, access to information by the public and notice
of public hearings, as such statutes and ordinances apply to the Town Council.
It shall be provided accommodations necessary to the conduct of its business
by the Town Manager. It shall be a budgeted agency of Town government and
may expend such funds or other funds assigned to its use by the Town Council
for carrying out its responsibilities, and such expenditures shall be made
in accordance with the fiscal procedures of the Town of Tolland.
The taking effect of this chapter shall in no way delay or otherwise
adversely affect any rights of action, suits, claims, liens, privileges, contracts
or other obligations which, prior to the effective date of this chapter, existed
in or against the Town of Tolland but shall be continued in or against the
Town Council acting as the Sewer Authority of the Town of Tolland as established
by this chapter.
