As used in this chapter, the following terms shall have the
meanings indicated:
HOBBYIST ACTIVITIES
Any recreational activity pertaining to or encompassing a
hobby, including but not limited to model car racing, model plane
flying, etc.
QUASI-PUBLIC PROPERTY
Property which, although privately owned, is opened to public
use. Examples of quasi-public property are shopping center parking
lots, indoor shopping malls, etc.
SKATEBOARD
A single platform which is mounted on wheels, having no mechanism
or other device with which to steer or control the direction of movement
thereof while being used, operated or ridden.
SPORTING ACTIVITIES
Any team or individual sports, including but not limited
to baseball, football, street hockey, handball, shuffleboard, Frisbee
throwing, etc.
Any person, firm or corporation violating any of the provisions of §
430-2 shall be subject to the following penalties:
A. First offenders shall have their skateboards or hobbyist equipment confiscated for a period of seven days as stated in §
430-2B. If the first offender is under the age of 18, said skateboard or hobbyist equipment will be returned to his or her parent or legal guardian only.
B. In addition to the confiscation of skateboards or hobbyist equipment as stated in §
430-2B, subsequent offenders under the age of 18 years of age who violate any of the provisions of this chapter shall be subject to discipline by the authority having jurisdiction over juvenile matters.
C. In addition to the confiscation of skateboards or hobbyist equipment as stated in §
430-2B, subsequent offenders 18 years of age or older who violate any of the provisions of this chapter shall be subjected to a fine not exceeding $100 in the discretion of the Municipal Court Judge before whom such person may be convicted.
No person shall participate in sporting activities on the grounds
surrounding the Toms River Township Municipal Complex or in the Municipal
Parking Garage located adjacent to the Municipal Complex at 33 Washington
Street.
Any person, firm or corporation violating any of the provisions of §
430-4 shall be subject to the following penalties:
A. Offenders under the age of 18 years of age who violate any of the
provisions of this chapter shall be subject to discipline by the authority
having jurisdiction over juvenile matters.
B. Offenders over the age of 18 years of age who violate any of the
provisions of this chapter shall be subjected to a fine not exceeding
$100 in the discretion of the Municipal Court Judge before whom such
person may be convicted.
No person shall use, operate or ride upon any skateboard on
any private or quasi-public property other than his or her own property
without the express, prior written consent of the owner and the occupant
of said property.
Any person, firm or corporation violating any of the provisions of §
430-6 shall be subject to the following penalties:
A. First offenders shall have their skateboards confiscated for a period
of seven days. If the first offender is under the age of 18, said
skateboard will be returned to his or her parent or legal guardian
only.
B. In addition to the confiscation of skateboards as stated in §
430-7A, subsequent offenders under the age of 18 years of age who violate §
430-6 shall be subject to discipline by the authority having jurisdiction over juvenile matters.
C. In addition to the confiscation of skateboards as stated in §
430-7A, subsequent offenders 18 years of age or older who violate §
430-6 shall be subject to a fine not exceeding $100 in the discretion of the Municipal Court Judge before whom such person may be convicted.
