A. From and after the effective date of this chapter,
it shall be unlawful to dump or dispose of or accumulate any refuse,
rubbish, garbage, ashes, offal, decaying or vegetable substance or
other spoiled matter, debris and other waste materials in any section
or sections, area or areas of this Township other than in the area
above-designated or in areas hereafter designated as public municipal
dumping areas for the residents of this Township, and such dumping
or disposing or accumulation of any refuse, rubbish, garbage, ashes,
offal, decaying or vegetable substance or other spoiled matter, debris
and other waste materials, other than in the area above-designated
or in areas hereafter designated as public dumping areas, is hereby
prohibited.
B. No person, corporation or agent or servant thereof
shall hereafter establish, maintain or permit any other dump or area
for the dumping or disposal or accumulation of refuse, rubbish, garbage,
ashes, offal, decaying or vegetable substance or other spoiled matter,
debris or other waste materials of any nature or dump or dispose of
or accumulate any refuse, rubbish, garbage, ashes, offal, decaying
or vegetable substance or other spoiled matter, debris or other waste
materials in any sections or areas in this Township, other than in
the area above-designated, or in areas hereafter designated as public
municipal dumping areas for the residents of this Township, except
that no motor vehicle with a weight registered with the New Jersey
Division of Motor Vehicles in excess of 5,000 pounds and such motor
vehicles as are owned, leased and/or operated by the Township of Toms
River shall be admitted to the areas designated under § 78-1 of this chapter for purposes of disposal of the waste
materials of any nature whatsoever.
The use and maintenance of any area or areas
for dumping or disposing of or accumulating refuse, rubbish, garbage,
ashes, offal, decaying or other vegetable substance or other spoiled
matter, debris or other waste materials, other than as designated
and permitted above, is hereby deemed and declared a detriment to
the public health, a nuisance and unlawful.

A. Any person convicted of violations of any of the provisions of Chapter
524 shall suffer a mandatory penalty of $1,000 for each such violation.
B. In addition to the penalty set forth in Subsection
A of this section, any person convicted of violations of any of the provisions of Chapter
524 shall receive a mandatory sentence of a minimum of 30 days of community service cleaning public lands and roadways for a first violation; and a mandatory sentence of a minimum of 60 days of community service cleaning public lands and roadways for any subsequent violation.
C. Notwithstanding the provisions of Subsections
A and
B of this section, the Toms River Township Law Department is authorized to take all necessary legal action, including the filing of a lawsuit, against any person convicted of violations of any provisions of Chapter
524 to recoup any costs incurred by the Township of Toms River as a result of said violation.
