Council finds that placement of indoor furniture at any location except
inside a structure, residential or otherwise, is detrimental to the well-being
of the City residents, as well as to their safety, and is, therefore, a public
health and welfare hazard.
As used in this chapter, the following terms shall have the meanings
indicated, unless a different meaning clearly appears from the context.
INDOOR FURNITURE
Any and all pieces of furniture which are made for only inside use,
including but not limited to upholstered chairs, sofas, davenports, beds,
divans and the like.
PERSON
Includes any individual, firm, corporation, association or partnership.
No person shall place or use outside of any structure any indoor furniture,
except if said placement is temporary to facilitate maintenance therein.
This chapter shall be enforced by the Police Department.
Any person who shall violate any provision of this chapter shall, upon
conviction thereof, be sentenced to pay a fine of not less than $100 nor more
than $500, for the first violation, and not less than $200 nor more than $1,000
for the second and subsequent offenses, plus restitution and costs, or in
default of payment, to imprisonment for a term not to exceed 30 days. Continuing
violations will be subject to citations every five days.
The remedies provided herein for the enforcement of this chapter or
any remedy provided by law or City ordinance shall be deemed mutually exclusive;
rather, they may be employed simultaneously or consecutively, at the option
of the City.
