A. Pursuant to the provisions of § 7-712 of the Village Law
of the State of New York, a Zoning Board of Appeals of five members
is hereby appointed for the Village of Athens, Greene County, New
York. Members and the Chairperson of such Zoning Board of Appeals
shall be appointed by the Mayor subject to the approval of the Board
of Trustees. The terms of members of the Zoning Board of Appeals first
appointed shall be so fixed that the term of one member shall expire
at the end of the Village official year in which such members were
initially appointed. The terms of the remaining members first appointed
shall be so fixed that one term shall expire at the end of each official
year thereafter. At the expiration of the term of each member first
appointed, his or her successor shall be appointed for a term which
shall be equal in years to the number of members of the Board.
B. Pursuant to the provisions of § 7-712 (7-a) and (9) of
the Village Law of the State of New York, members of the Zoning Board
of Appeals shall complete, at a minimum, four hours of training each
year designed to enable such members to more effectively carry out
their duties. Training received by a member in excess of four hours
in any one year may be carried over by the member into succeeding
years in order to meet the requirements of this subdivision. Such
training must be approved by the Village Board of Trustees in order
to be valid. Failure to complete such training shall result in the
ineligibility of the Zoning Board of Appeals member to be reappointed
and shall be cause for removal by the Village Board of Trustees following
public hearing.

Pursuant to the provisions of § 7-728
of the Village Law of the State of New York, the said Planning Board
of the Village of Athens, Greene County, New York, hereby appointed,
shall be and is hereby authorized and empowered to approve preliminary
and final plats showing lots, blocks or sites, with or without streets
or highways, in the Village of Athens, Greene County, New York, and
further, is authorized and empowered to approve the development of
plats entirely or partially undeveloped and which have been filed
in the office of the Clerk of Greene County prior to the appointment
of the Planning Board and the grant to said Board of the power to
approve plats.

Pursuant to the provisions of § 7-725-a of the Village Law of the State of New York, the said Planning Board of the Village of Athens, Greene County, New York, shall be and is hereby authorized to review and approve, approve with modifications or disapprove site plans, prepared to the specifications set forth in §
250-34 of Chapter
250, Zoning, of the Code of the Village of Athens, showing the arrangement, layout and design of the proposed use of the land shown on such plan.
The Clerk of the Village of Athens, Greene County,
New York, is hereby directed to forthwith file with the Clerk of the
County of Greene a certificate showing that the Board of Trustees
of the Village of Athens, Greene County, New York, has authorized
its Planning Board to approve plats showing new streets or highways
within the Village of Athens, Greene County, New York, pursuant to
the provisions of § 7-728 of the Village Law of the State
of New York, and the said Clerk is hereby requested to write to the
County Clerk of Greene County and request such Clerk, pursuant to
the provisions of § 7-732 of the Village Law of the State
of New York, to refuse to file or record in his office any plat of
a subdivision of land showing a new street or highway until it has
been approved by the Planning Board of the Village of Athens, Greene
County, New York.

For various reasons, including illnesses, vacations and conflicts
of interest, it is sometimes not possible to obtain or maintain a
quorum of the Planning Board. Such failure to obtain or maintain a
quorum may delay or impede such Boards in meeting their responsibilities.
The purpose of this article is to authorize the appointment and service
of an alternate member of the Planning Board when necessary to achieve
a quorum.
As used in this article, the following terms shall have the
meanings indicated:
