A. Unless the context specifically and clearly indicates
otherwise, the word “person” shall mean any individual,
partnership, company, association, society, public or private corporation,
or other group or entity.
B. The Supervisors hereby create a fire hydrant district
encompassing the entire area of the Township of East Allen.
C. The Supervisors hereby levy a tax on all improved
property in said Township abutting upon highway, streets, roads and
alleys, or portions thereof, which is serviced by water mains for
fire hydrants or are located within 780 feet of a fire hydrant to
which the Township is supplying and maintaining water for the safety
and convenience of the inhabitants of the Township, for the fiscal
year 1995 and each year thereafter until amended or repealed. Said
tax shall be as set from time to time by resolution of the Board of
Supervisors. This assessment shall not be levied against any farm
land or land used as an aviation field or against other property in
the district not benefited thereby.
D. All persons supplying or maintaining water and fire
hydrants which are assessable to the inhabitants of the Township shall
annually be required to have said hydrants inspected by a volunteer
fire company operating within the Township of East Allen to determine
if the hydrant is operable and the amount of water pressure that exists
at said hydrant. The inspecting fire company shall report the results
of its inspection in writing to the Township Secretary.
E. Any person who shall fail to comply with the provisions of Subsection
D of this section shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense.

A. Definition; district established; imposition of tax.
(1) Unless the context specifically and clearly indicates
otherwise, the word “person” shall mean any individual,
partnership, company, association, society, public or private corporation,
or other group or entity.
(2) The Supervisors hereby create a fire hydrant district
encompassing the area of the Township as detailed on the attached
exhibit.
(3) The Supervisors hereby levy a tax on all property
in said Township abutting upon highways, streets, roads and alleys,
or portions thereof, which is serviced by water mains for fire hydrants
or are located within 780 feet of a fire hydrant to which the Township
is purchasing water from the City of Bethlehem, for the safety and
protection of the inhabitants of the Township, for the fiscal year
1995. Said tax shall be as set from time to time by resolution of
the Board of Supervisors. This assessment shall not be levied against
any farm land or land used as an aviation field. After 1995, each
year the levy shall be set by resolution at the Supervisors’
reorganization meeting.
B. Discounts and penalties. All taxpayers subject to
the payment of the hydrant taxes herein levied and assessed shall
be entitled to a discount of 2% of the amount of such tax upon making
payment of the whole amount thereof within two months after the date
of the tax notice. All taxpayers who fail to make payment of any such
taxes charged against them for a period of four months after the date
of the tax notice shall be charged a penalty of 10%.
C. Collection by the elected Township Tax Collector.
Said tax shall be collected by the elected Tax Collector of Township
taxes for the Township of East Allen. Delinquencies occurring at the
end of the said tax year (being February 28) will be reported to the
Township Secretary by March 1 to be turned over to the appointed Delinquent
Tax Collector for collection.
D. Authorization for changes. The Board of Supervisors
is authorized to establish additional regulations or changes as deemed
necessary. Said changes or regulations may be authorized by resolution.
