All proposed utilizations of outdoor chemical toilets, commonly referred to as "jiffy johns," for temporary use in connection with construction activities, athletic events and outdoor social activities shall require the securing of a permit from the Jackson Township Zoning Officer at the Township Municipal Building, 439 Roth's Church Road; Spring Grove, Pennsylvania.
A. 
Chemical toilets shall meet the design specifications of the manufacturer, provided that such specifications allow for a safe and sanitary operation and preclude any potential for health hazards, and the design of chemical toilets shall be of a type approved by the Pennsylvania Department of Environmental Protection.
B. 
If it remains or is to remain more than six months, whether by permit or permit and renewal, it shall be installed no less than 200 feet from any dwelling house or building of human habitation. If it is to remain less than six months, it shall be no less than 75 feet from any dwelling house or building of human habitation except that, where it is not possible to obtain the seventy-five-foot distance, it must be at the farthest possible distance but in any event no less than 50 feet.
C. 
The location shall be reasonably level, accessible to servicing trucks, not within any road right-of-way, and on the property upon which the activity requiring use of the chemical toilet is located.
D. 
The toilet must be serviced as needed to maintain safe and sanitary operation so as not to become a health or nuisance hazard.
All applications shall clearly indicate the approximate location of the installation and the estimated length of use.
The permit for the installation of such outdoor chemical toilets shall be limited to a period of not more than six months, at which time it will be necessary to reapply for a renewal of the permit.
The applicant shall pay a fee as established from time to time by resolution of the Board of Supervisors. The fee is payable at the time of the filing of the application, and a similar fee will be due for each renewal of the permit that the Township may authorize if renewal is justified.
Any person violating any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than 1,000 plus costs of prosecution, and in default of payment of said fine and costs, shall be sentenced to a term of imprisonment not to exceed 30 days. Each day a violation continues shall be deemed a separate offense.
