No local law shall be adopted by the Town Board of the Town
of Amherst until a public hearing has been held thereon before such
Town Board not less than three days nor more than 30 days after public
notice has been given of the time and place of the holding of such
public hearing. The notice shall be given by the Town Clerk by causing
the same to be published once in the official newspaper of the Town.
The notice shall contain the title of the proposed local law with
its text verbatim or by reference, as hereinafter provided, or a brief
explanatory statement thereof.
Upon adoption of a local law by the Town Board, the Town Clerk
shall cause a notice thereof containing the text of the law verbatim
or by reference, as hereinafter provided, to be published in the official
newspaper of the Town. Proof of publication shall be filed by the
Clerk in his office.
Local laws may be proposed and enacted by reference to all or
parts of model laws, codes, ordinances, regulations and rules or laws,
codes, ordinances, regulations and rules enacted or published by the
Town of Amherst, Erie County, New York State or the United States
of America, or their agencies or departments, or by any other person,
organization or body. The notice of hearing or adoption shall contain
the title, publication date and edition number of the law, code, ordinance,
regulation or rule to which reference is made. A copy of the material
referred to shall be filed in the Town Clerk's office.
Each local law shall be numbered consecutively beginning with
number one for each calendar year.
This chapter shall take effect immediately.
