The use of any herbicide, substance or mixture of substances intended for use as a plant regulator, defoliant or desiccant, which contains any substance identified as carcinogenic by the National Cancer Institute is prohibited on rights-of-way, including power lines, railroads or for any uses other than agricultural or domestic, within town borders.
The penalty for the violation of this chapter shall be a fine of not more than two hundred dollars ($200.) per day. This chapter shall be enforced by a town police officer upon request of the Board of Health or the Conservation Commission. The Board of Selectmen and the Town Counsel shall take such legal action as necessary to enforce this chapter.
