It shall be unlawful from and after the passage of this chapter
between May 1 and October 1 in any year for any person or persons,
either as principal or agent, to permit the playing of any musical
instruments, including phonographs, and any singing and dancing in
any building in the Borough of Towanda, Bradford County, Pennsylvania,
which is licensed for the sale of alcoholic beverages or where nonalcoholic
beverages are sold or exposed for sale between the hours of 12:00
midnight and 8:00 a.m., either Eastern standard time or Eastern daylight
saving time, as the same is being observed within Towanda Borough.
Any person, either as principal or agent, violating any of the
provisions of this chapter shall be subject to a fine of not less
than $10 nor more than $25 for each offense, to be collected in a
summary proceeding before the Mayor or any Magisterial District Judge
in and for the Borough of Towanda, and in default of any payment of
such fine and costs, the offender shall be imprisoned in the County
Jail of Bradford County for a period not exceeding one day for each
$1 of fine and costs.
Repetition of such violation is hereby declared to be a common
nuisance, and at the instance of the Town Council proceedings shall
be begun to enjoin such repetition, and if deemed advisable, to close
the place of business at 12:00 midnight.
