There is hereby created under the terms of this chapter a Municipal Water and Sewer Utility within the Borough of Clayton, in the County of Gloucester and State of New Jersey, which utility shall be publicly owned and shall for accounting purposes be a separate utility, having its own borrowing capacity, its own separate account and its own separate property, whether it be real, personal or mixed. The name by which it shall be known shall be the "Borough of Clayton Water and Sewer Utility."
It shall be the function of the Water and Sewer Utility to own and to operate all water facilities, plants, lines and equipment pertaining to the handling of water and the treating of water and also the sewer facilities, plants, lines and equipment pertaining to the handling of sewage and the treating of sewage in and for the Borough of Clayton.
The Water and Sewer Utility shall be governed by the ordinances and resolutions of the Mayor and Council of the Borough of Clayton. All appointments, as well as hiring and dismissal of employees, shall be done according to the rules and regulations as adopted by the Mayor and Council of the Borough of Clayton.
The financial affairs of the Water and Sewer Utility shall be governed by the Mayor and Council of the Borough of Clayton. The Water and Sewer Utility shall be from time to time authorized to borrow money on its own credit by ordinance adopted according to law by the Mayor and Borough Council of the Borough of Clayton.
The Water and Sewer Utility may from time to time acquire such real and personal property as may be authorized by the Mayor and Borough Council of the Borough of Clayton by duly adopted ordinance according to the laws of the State of New Jersey.
The Mayor and Council of the Borough of Clayton shall have full authority to appoint and employ all necessary employees for the Water and Sewer Utility; however, the salary of said employees or appointments of the Water and Sewer Utility shall be paid from separate funds of said utility.
The Water and Sewer Utility shall at all times function and operate according to the laws of the Borough of Clayton, County of Gloucester and State of New Jersey, and the directives of all pertinent federal or state agencies.
The Water and Sewer Utility shall from time to time, when necessary, be permitted to receive moneys from the general funds of the Borough of Clayton, whether by grant or loan.
The Water and Sewer Utility shall have the authority to collect moneys by levying a water and a sewer rental charge against the property owners of the Borough of Clayton for the annual water and sewer service to said property owners, said moneys to be used by the Water and Sewer Utility to defray cost of construction and operation of the water and sewer system and all of its integral parts, including lines and equipment.
The position of Sewer Superintendent of the Borough of Clayton is hereby created. Said Sewer Superintendent shall perform such duties as are required by law and as shall be prescribed by the Mayor and Council of the Borough of Clayton.
This chapter shall take effect on January 1, 1992, after final adoption and publication as required by law.
