It shall be the duty of every owner, tenant, lessee or occupant of every building within the corporate limits of the Borough of Clayton to provide or cause to be provided and to keep on the premises, at all times, suitable plastic or regulation paper trash bags with twist ties, designed for trash and garbage combined disposal, in watertight, closely covered receptacles for receiving and holding only the garbage and other animal and vegetable refuse that may accumulate or be collected in the premises.

A. 
Scope. The following regulations shall govern the storage, placement and collection of garbage and trash produced or otherwise created within the Borough of Clayton. Combined garbage and trash collection will be furnished by the Borough of Clayton to all premises within the Borough on a weekly basis, unless otherwise specifically provided. All premises within the Borough shall make use of the system of garbage and trash storage, placement and collection in accordance with the applicable provisions of this Part 1; provided, however, that garbage and trash from each commercial and industrial establishment and garden apartment complex, placed for collection by the Borough or its contractor, shall be limited to a maximum of four thirty-gallon containers (or equivalent) for each collection day. Any garbage or trash in excess of said quantity shall be stored, collected, removed and disposed of by the owners or operators of such commercial or industrial establishments and garden apartment complexes at their own expense.

B. 
Refuse acceptable for collection. All garbage and trash, except for those items regulated by Article II of this Part 1, shall be acceptable for collection, provided that the storage and placement of said garbage and trash is in compliance with the applicable provisions of this Part 1.
C. 
Refuse not acceptable for collection. The following refuse shall be considered to be not acceptable for collection by the Borough of Clayton:
(1) 
Dangerous materials or substances, such as poisons, acids, caustics, noxious chemicals, infected materials, explosives and ammunition or any other materials likely to cause injury to persons employed or damage to equipment used in making collections.
(2) 
Unusual quantities of materials resulting from the demolition, repair, excavation, construction, renovation and similar activities performed upon buildings or structures, including but not limited to such materials as earth, plaster, mortar, lumber, roofing materials and the like. Contractors and/or owners and/or tenants shall be responsible for disposing of such materials.
(3) 
Loose piles of vegetation or tree branches unless properly prepared for collection.
(4) 
Heavy units exceeding 50 pounds in gross weight.
(5) 
Materials which cannot be disposed of in strict accordance with the standards and regulations prescribed by the New Jersey Department of Environmental Protection, the New Jersey Board of Public Utilities Commissioners and any other governmental agency or department having jurisdiction for the disposal of waste materials by the sanitary landfill method.
D. 
Storage, placement and collection of refuse.
(1) 
Storage. All refuse shall be stored in receptacles as described in § 60-1 which shall be kept covered at all times and shall be maintained in a clean and proper condition for safe handling. Plastic trash bags may be utilized, provided that they are securely tied and of sufficient strength to allow being picked up without tearing or breaking. The Borough of Clayton may affix a notice to containers which do not qualify under the requirements of this Part 1 indicating that the containers do not qualify and that further use of said containers may result in confiscation of the containers or refusal to make the collection as specified in this Part 1. If at the next regularly scheduled collection date said containers still do not conform to the requirements of this Part 1, the Borough of Clayton may collect the containers as specified and/or refuse to make the collection as specified in this Part 1.
(2) 
Placement.

(a) 
All receptacles shall be placed by the owner, tenant, lessee or occupant of the building at the curbline, or other designated area, before 4:00 a.m. on the days designated for collection; provided, however, that said placement at the curbline shall be made not more than 10 hours prior to 4:00 a.m. of the days designated for collection. Receptacles not disposable must be removed from the curbline, or other designated area, within 10 hours after refuse has been collected.[1]

(b) 
In the event that the distance from the entrance to the structure which is inhabited is greater than 100 feet to the curbline, or other designated area, then it shall be the responsibility of the owner of the property to transport, or hire someone to transport, any and all garbage and trash, whether recyclable or not, that is to be placed at curbside, or other designated area, for collection.
(3) 
Collection. Every contractor, and any employee or employees of such contractor, and every other person authorized by the Borough of Clayton to collect garbage and trash shall deposit the same in a watertight covered wagon, box, tank or receptacle. Said collections shall be made between the hours of 4:00 a.m. and 6:00 p.m. of the days designated for collection by the Borough Council of the Borough of Clayton.
No person engaged in the collection of garbage and trash shall obtain the same except by means of the sidewalk, paths or other means of access. No person shall trespass upon the lawn or damage any property of the owner or occupant of any house, residence or building in the Borough of Clayton.
No contractor, or any employee or employees of the contractor, or any other person authorized by the Borough of Clayton to collect garbage and trash shall, in the course of such operation, cause or allow any such garbage or trash or any portion thereof or litter or debris emanating therefrom to be distributed in and along any of the streets, highways or public places of the Borough of Clayton, nor shall the same be deposited, thrown or placed upon any lot, property, streets, alleys, highways or other locations within the Borough of Clayton.
The Borough Council shall have the power to make a contract or contracts for the collection, removal and disposal of garbage and trash with any individual or corporation. Said contracts shall be entered into and made only after bids therefor have been received according to law, and then only to the lowest responsible bidder. The person or corporation to which such contract is awarded shall give satisfactory bond or security for the faithful performance of the work.
