A. 
This Legislature finds and determines that the County of Suffolk enacted Local Law No. 23-1996 with the stated legislative intent ". . . that there is a natural progression of salary scales between management and labor which ensures fair compensation, affordable personnel costs, high employee morale and discipline, and incentives for employees to strive to move up the career ladder of County employment."
B. 
This Legislature finds and determines that Local Law No. 23-1996 was declared ". . .unconstitutional, invalid and unenforceable. . ." as to employees covered by collective bargaining agreements.
C. 
This Legislature finds and determines that as a result of judicial determination the rational and commendable legislative intent of Local Law No. 23-1996 would be unattainable unless the provisions of Local Law No. 23-1996 are modified.
D. 
Therefore, the purpose of this article is to modify certain provisions of Local Law No. 23-1996 to achieve the theory that there is a natural progression of salary scales between management and labor which ensures fair compensation, affordable personnel costs, high employee morale and discipline, and incentives for employees to strive to move up the career ladder of County employment.
A. 
Except as otherwise set forth in this article, no exempt management employee or elected official excluded from a bargaining unit shall receive a salary as provided by the pertinent salary plan equal to or in excess of that year’s budgeted annual salary for the County Executive.

B. 
The Police Commissioner and the Deputy Police Commissioner shall not receive the stipend in lieu of overtime contained in Section 26 of the collective bargaining agreement of the Superior Officers Association.
C. 
The County Comptroller is hereby authorized, empowered and directed, pursuant to § C5-2I of the Suffolk County Charter, to make such adjustments in biweekly paychecks, or other forms of payment to an employee or officer, or withhold such payments, as may be necessary to ensure compliance with Subsections A and B of this section.

This article shall not apply to the following positions:
A. 
President of Suffolk County Community College;
B. 
Commissioner of Health Services;
C. 
Chief Medical Examiner; and
D. 
Chief Deputy Medical Examiner.
This article shall apply to any compensation paid by the County of Suffolk on or after January 1, 1998, and shall affect fiscal year 1998, as well as any year subsequent to this article's effective date.
