No parade, procession or assemblage, other than funeral processions,
shall be held on or along any of the public streets or highways of
the Borough, unless a permit shall first have been issued therefor
and shall then remain in force in accordance with the provisions of
this chapter.

The Mayor shall have authority, on application of any responsible
person, persons, or organization acting by duly authorized representatives,
to issue a permit for the holding of a parade, procession or assemblage
on or along designated public streets or highways of the Borough if
the Mayor shall be satisfied that such parade, procession or assemblage
can and will be conducted without causing public disorder or unreasonable
danger to persons or property.
Every application for a permit under this chapter shall be in
writing, signed by the applicant or applicants, stating the nature
and purpose of such parade, procession or assemblage, the name and
character of any organization sponsoring it, the day and hour or hours
when, and the street or streets and the particular parts thereof on
which it is to be held.

If the applicant shall request it, or if the Mayor shall deem
it necessary for the safety and convenience of the public, he may
issue an order limiting or prohibiting the movement of traffic on
and the parking of vehicles along the route, or parts of the route,
of any such parade or procession during the hours covered by the permit
and for a reasonable length of time prior thereto and authorizing
the applicants to erect official signs in connection therewith which
shall be subject to approval of the Mayor and conform to all requirements
of law, provided that no such restriction or prohibition shall remain
in force at any place after the parade or procession shall have finally
passed that point. No such restriction or prohibition as to the movement
of traffic shall be effective unless safe and prominent barriers and
direction signs shall be erected or officers or other designated persons
shall be on duty to direct traffic, nor, in case of state highways,
until any required consent of state authorities shall have been obtained
by the applicant or applicants. No such restriction or prohibition
as to parking shall be effective unless signs stating the restriction
or prohibition and the hours thereof shall be conspicuously posted
at intervals of not less than 200 feet along the side or sides of
any street to which such restriction or prohibition shall be applicable.
Such signs shall be erected not less than six hours before the parking
restriction or prohibition shall be in force, but failure to have
signs erected in that time shall afford no defense to any action or
prosecution for violation of the regulations unless the defendant
shall show that he was legally prejudiced by such delay.

The applicant or applicants to whom any permit shall be issued
hereunder shall, at their own cost, obtain all necessary consents
from state authorities and shall provide all signs and barriers, and
for the erection and removal thereof, which shall be required for
any traffic or parking restriction or prohibition which shall be either
requested by the applicant or required by the Mayor.
Every permit issued hereunder shall specify the day and hours
for which it is issued and the streets or parts of streets on which
the proposed parade, procession or assemblage may be held.

Before issuing any such permit, the Mayor may require the applicant
or applicants, individually or on behalf of any applicant organization,
in writing, to undertake to obtain any necessary consent of other
public authorities and to comply with all the requirements of this
chapter and, specifically, to provide for erection and removal of
such signs and barriers and persons to direct traffic as the Mayor
may deem necessary in connection with any traffic or parking restrictions
or prohibitions requested by the applicant or required by the Mayor.
The Mayor may require the applicant or applicants to furnish reasonable
security for compliance with this chapter and the conditions of the
permit.

Every permit issued hereunder shall be effective only upon the
condition that the applicant or applicants shall fully comply with
all the requirements of this chapter and of the Mayor hereunder. If
the applicant or applicants shall fail to comply with any condition
required to be performed before the holding of such parade, procession
or assemblage, or if it shall appear that the holding thereof will
be likely to cause serious public disorder or danger to persons or
property, the Mayor may revoke the permit by notice thereof to any
one of the applicants before the beginning of such parade, procession
or assemblage.

In the absence of the Mayor from the Borough for more than one
day, the President of Council shall have all the powers and authority
herein given to the Mayor.

A. Any person who shall violate any provision of this chapter, other
than traffic and parking violations, shall, upon conviction thereof,
be sentenced to pay a fine not exceeding $600 and costs and, in default
of payment thereof, shall be subject to imprisonment for a term not
to exceed 30 days. Each day that a violation of this chapter continues
shall constitute a separate offense.
B. Traffic and parking violations shall be in accordance with penalties and fines set forth in Chapter
255, Vehicles and Traffic, hereof or in the Vehicle Code, 75 Pa.C.S.A. § 101 et seq.
