It is the purpose of this chapter to promote the health, safety,
morals and general welfare of the inhabitants of the Village of Interlaken
by more definite requirements for mobile homes and manufactured homes
located outside of a mobile home park.
As used in this chapter, the following terms shall have the
meanings indicated:
MANUFACTURED HOME
A.
A single-family dwelling as defined in 42 U.S.C. § 5402(6),
as a "structure, transportable in one or more sections, which, in
the traveling mode, is eight body feet or more in width or 40 body
feet or more in length, or, when erected on site, is 320 or more square
feet, and which is built on a permanent chassis and designed to be
used as a dwelling with or without a permanent foundation when connected
to the required utilities, and includes the plumbing, heating, air
conditioning, and electrical systems contained therein..." and have
a permanent chassis to which wheels are attached to tow the home to
its site. The definition is intended to include single- and double-wide
units.
B.
The terms "mobile home" and "manufactured home" do not include
or refer to the following:

"Factory manufactured homes" or "modular homes," as defined
in N.Y. Executive Law § 372(8), as "a structure designed
primarily for residential occupancy constructed by a method or system
of construction whereby the structure or its components are wholly
or in substantial part manufactured in manufacturing facilities, intended
or designed for permanent installation, or assembly and permanent
installation, on a building site."

MOBILE HOME
A single-family dwelling that is wholly, or in part, fabricated
in an off-site manufacturing facility for installation or assembly
at the building site, designed to be a permanent residence, and built
prior to the enactment of the Federal Manufactured Housing Construction
and Safety Standards Act of June 15, 1976.
MOBILE HOME PARK
Any lot on which two or more structures that fall under the
definition of "mobile home" or "manufactured home" are located, regardless
of whether or not a charge is made for such accommodations and has
a valid permit issued by the County of Seneca to operate as a mobile
home park.
No mobile homes, as defined by this chapter, and built prior
and outside of compliance with to the enactment of the Federal Manufactured
Housing Construction and Safety Standards Act of June 15, 1976, shall
be allowed as new construction or installation after the effective
date of this chapter, except within a mobile home park. Existing mobile
homes shall be allowed to continue on their present lot(s) indefinitely.
However, any replacement structure must comply with the provisions
of this chapter.
No person, firm or corporation being the owner or occupant of
any land or premises within the Village of Interlaken shall use or
permit the use of said land or premises for parking or placement thereon
of a manufactured home, as defined by this chapter, without obtaining
a permit.
A. Application for permit. Any person or persons applying for a permit
to maintain an individual manufactured home in the Village of Interlaken
must submit to the Village Board a description of the land or premises
upon which the proposed manufactured home is to be located, including
a plot plan of the property and a proposed layout showing the extent
and the area to be used for such purposes, together with the proposed
locations or site for such manufactured home, together with an application
fee of $100.
B. Conditions for issuance of permit. Before a permit is issued by the
Village Board, the applicant must demonstrate that he or she will:
(1) Comply with all area regulations fifty-foot frontage; five-foot setback
all property lines, for a conventional single-family residence in
a residential area.
(2) Give a firm base and adequate support for the manufactured home with
a full concrete stand at least six inches thick or a foundation with
footers below frost line.
(3) Provide anchors or tie-down at least at the corners, capable of securing
the stability of the manufactured home as per county code.
(4) Remove any hitch, tires and wheels.
(5) Provide the manufactured home with skirts to screen the space between
the manufactured home and the ground. Such skirts shall be of two
by four AVM/or concrete block. A permanent material similar to that
used in the manufactured home and providing a finished exterior appearance
shall be fastened to two by four frame within four months form the
issuance of the permit.
(6) The manufactured home shall have a shingled roof.
(7) Provide that the construction of storage space, additional rooms
or enclosed patios or carports shall have a finished exterior appearance.
No exposed building paper, wallboard or other structural material
will be permitted.
(8) Provide separate hookup for water and sewer service in accordance
with all applicable state and local laws.
A violation of this chapter shall be an offense and shall be
punishable by a fine of up to $500 for each week's continued
violation. Any person who violates this chapter may remedy the violation
within one week of written notice of said violation without monetary
penalty.
