The starting, stopping, running or operating in any manner of any motorcycle, trailcycle, minibike or other similar vehicle in any public park or parklet situate in or belonging to the Borough shall be and the same is hereby prohibited.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.

A. 
The following acts by any person within the confines of Andrew Bayne Memorial Park, Bayne Park and Gilotte Park shall be and the same are hereby prohibited:
(1) 
Climbing trees, cutting, breaking, injuring, defacing or disturbing any tree, shrub, plant, rock, building, monument, fence, bench or other structure, apparatus or property; plucking, pulling up, cutting, taking or removing any tree, shrub, bush, plant or flower; gathering or taking any fruit or nut; cutting, writing or marking upon any building, monument, fence, bench, table or other structure, apparatus or property.
(2) 
Injuring, defacing or destroying any notice, rule or regulation posted for the government of the park.
(3) 
Cutting or removing any wood, turf, grass, soil, rock, sand or gravel.
(4) 
Making or kindling a fire for any purpose, except in places expressly provided therefor by the park management.
(5) 
Indulging in riotous, boisterous, threatening, immoral or indecent conduct.
(6) 
Using any abusive, threatening, profane, immoral, indecent or suggestive language.
(7) 
Selling or offering for sale any merchandise, article or thing whatsoever except through duly authorized concessions.
(8) 
Throwing or depositing any bottle, tin can, broken glass, paper, clothes, rubbish or offal of any description except in receptacles provided for that purpose.
(9) 
Leading or permitting to run loose any animal or fowl of any kind.
(10) 
Riding or driving or propelling or causing to be propelled any vehicle or automobile elsewhere than on the roads or drives provided for such purpose.
(11) 
Riding or driving any vehicle of any kind at a speed exceeding 15 miles per hour.
(12) 
Parking of any vehicle shall be only in designated parking areas and shall be limited to patrons or persons using the facilities of Andrew Bayne Memorial Library.
(13) 
Carrying or discharging firearms or fireworks within the limits of the park except by permit.
(14) 
Carrying any kind of lighted pipe, cigar, cigarette or any other lighted smoking device and any other use of smoking tobacco products in any area of the park.
(15) 
No person shall, for any purpose whatsoever, bring onto any part of the premises presently or hereafter used as a part of the Andrew Bayne Memorial Park, Bayne Park and Gilotte Park any intoxicating liquor or malt beverage of any kind whatsoever, nor shall any person while on any part of said premises consume or imbibe any intoxicating liquor or malt beverage of any kind whatsoever. Violation of this subsection or any part thereof shall make the offender liable not only for the penalties hereinafter provided for, but shall subject such offender to permanent exclusion from the use of the facilities of the park or any part thereof.
(16) 
The playing, engaging or participation in any game, sport or athletic event other than those games, sports or athletic events for which facilities, areas, fields or courts are specifically provided and then only under such conditions and those periods of time as established by rules and regulations as are specifically adopted as hereinafter set forth. The violation of said rules and regulations shall be considered to be a violation of this article and shall be subject to penalties herein provided.
B. 
The erection and maintenance of all necessary signage is hereby authorized; said signage shall be placed so as to properly notify all persons of the prohibited activities.

In addition to the general rules governing users of Bayne Memorial Park, the following rules and prohibited acts shall apply to all persons using the Skate Plaza facility within the confines of Andrew Bayne Memorial Park:
A. 
The Skate Plaza is a skate-at-your-own-risk facility. This is a nonsupervised facility designed for skateboarding, in-line skating, and BMX bike riders (no pegs) only. No ramps, fun boxes or grind rails are allowed.
B. 
Helmets, knee pads, elbow pads and wrist pads are required for all participants under the age of 12 and are recommended, but not required, for all other participants.
C. 
Children under the age of 12 must be accompanied by a parent or guardian when using this facility.
D. 
The Skate Park is open daily from 9:00 a.m. to sunset.
E. 
Skateboarding is prohibited outside the Skate Plaza area in Bayne Park.
F. 
Skateboarding and BMX bikers are not allowed to be on the plaza at the same time. If a conflict arises, each group will be given thirty-minute alternating uses of the plaza.
G. 
Alcohol, drugs, cigarette smoking or tobacco products are not permitted.
H. 
Obscene or abusive language is prohibited.
I. 
No glass containers are permitted.
J. 
No littering.
K. 
No loud music is allowed on the premises.
L. 
The Borough is not responsible for lost or stolen items.
M. 
The Borough of Bellevue reserves the right to revoke skate and/or bike privileges to individuals who do not obey these rules. In addition, violators may be subject to penalties for Borough ordinance violations as set forth hereinafter.

The park shall be closed each night between the hours of sunset and sunrise the following morning, and the loitering, lounging or being present in the park at any time within said hours shall be deemed a violation of this section, except that this limitation shall not apply to any person using the walkway for ingress, egress and regress to and from North Balph Avenue and Teece Avenue. Special permits may be obtained to remain in the park until 11:00 p.m. for valid reason given.
No company, society or organization shall hold or conduct any picnic, celebration, parade, service or exercise without first obtaining a permit, and it shall be unlawful for any person to take part in any picnic, celebration, service or exercise held or conducted contrary to the provisions hereof.
All permits provided for hereunder shall be issued through the Borough Secretary.
There is hereby granted to the Public Works Committee of Council the authority to make and enforce reasonable rules and regulations relative to the conduct of employees of the Borough while on duty within the territorial limits of Andrew Bayne Memorial Park, Bayne Park and Gilotte Park, including therein power to suspend or dismiss such employees upon any infraction of such rules and regulations.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof before any Magisterial District Judge, be sentenced to pay a fine of not less than $25 or more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
