For the purposes of this article, the following terms shall
have the meanings indicated:
TEMPORARY STRUCTURE
Includes any and all portable structures, portable buildings,
trailers, roll-off trailer boxes, self-propelled vehicles and any
and all structures of any kind or nature which are not generally considered
as and/or taxed as real estate, including, but not limited to, structures
used for office space, meeting rooms, training activities, sleeping
quarters, game rooms, medical and first aid stations, treatment or
testing facilities, laboratories, showers and wash houses, change
rooms, locker rooms, decontamination stations, lunchrooms, fabrication
or manufacturing facilities, food preparation/sale/service facilities
and storage facilities.
All temporary structures placed, maintained or otherwise located
on any site shall conform to the requirements of the zoning district
in which they are located.
All temporary structures placed, maintained or otherwise located
on any site for more than 31 days shall conform to the following requirements:
A. Placement shall be on a hard, suitable surface such as asphalt, concrete,
cement or other surface as may be approved by the Borough Building
Inspector.
B. The structure shall be blocked and/or supported in such a manner
as to prevent it from rocking, tipping or moving.
C. The structure shall be secured by straps, tie-downs or other appropriate
method to the surface on which the temporary structure is located.
D. The temporary structure shall have a solid skirt placed around the
structure to prevent trash, debris and other items from accumulating
under the structure.
E. No space under the structure, including the space within the skirting
area, shall be used for storage of any type.
F. Any and all steps, ramps, ladders and platforms used as ingress and
egress to the structure shall be of approved construction techniques
and design and appropriately secured.
G. Any and all platforms in areas between two temporary structures and/or
between a temporary structure and a permanent building or permanent
structure shall not be roofed, covered over or enclosed in any manner.
However, temporary tarps may be used between temporary structures
in fabrication areas upon the condition that, when any torches, welding,
sparking or any other equipment, devices or items are being used which
have fire safety hazards, there shall be proper on-site fire extinguishers
available. All fire extinguishers are subject to the approval of the
Borough Fire Marshal. Further, firesafety precautions will be required
as may be directed by the Borough Fire Marshal. All tarps and similar
devices must be made of fire-resistant materials.
H. All temporary structures must be located the minimum distance of
six inches above any surface on which the structure is to be located
in order to prevent the harborage of rodents and other animals.
I. All drains, air-conditioning units and other devices of any kind
or nature which emit water onto the ground must be routed in such
a manner to prevent the accumulation of standing water.
J. Any temporary structure which is located on, at or near any Borough
street must be properly marked and lighted and placed in a location
subject to the approval of the Trainer Borough Police Department so
as not to impair the safe and expedient flow of traffic and pedestrians.
Compliance with each and every regulation contained within the
preceding section of this article shall be subject to the inspection
and approval of the Borough Building Inspector and/or his deputy.
Prior to the placement of any temporary structure upon any property
within the Borough, a temporary trailer/building placement request
form must be obtained from the Municipal Building of the Borough of
Trainer, completed and submitted to the Building Inspector along with
payment of the applicable fee. Further, prior to placement, the Building
Inspector must approve placement after inspection of the site. Further,
after placement, the Building Inspector must again inspect the temporary
structure for compliance with the regulations contained within this
article before occupancy and/or use of the temporary structure may
be made. This article does not relieve any firm, person or corporation
from the necessity to comply with the Borough's electrical, plumbing,
health, safety and other applicable codes.

A. Any person, firm, partnership, company or corporation applying for
a temporary trailer/building placement request form must pay a fee
of $150 to the Borough of Trainer at the time of the submission of
the request form. In the event that a reinspection is required, there
shall be an additional fee of $40 for each inspector required to reinspect.
B. The Building Inspector, Plumbing Inspector and Electrical Inspector
will each receive $30 for each inspection and reinspection, pass or
fail. Said amounts shall be paid to the inspectors by the Borough.
C. Upon passing all inspections, the temporary trailer/building placement request form shall be marked as "approved," and the approved form shall be considered a permit for the subject temporary structure. Permits shall expire on December 31 of the year in which the permit was issued. In the event that the temporary structure remains in place beyond December 31 of the year in which the permit was issued, an application for reinspection must be completed and a reinspection must be performed and passed. The reinspection fee for subsequent calendar years shall be the same as specified in Subsection
A hereof. However, in the event that any temporary structure has been in place for fewer than 100 days, the permit shall be valid for a minimum of 100 days, even if 100 days would extend beyond December 31 of the calendar year in which the permit was first issued.
D. In the event that the temporary structure/trailer or other item requiring
to be permitted under this article remains in existence on or after
January 1 of the calendar year immediately following the year in which
the permit was issued, the new temporary trailer building placement
request form must be completed and submitted to the Borough and the
new permit fee paid on or before January 15.
Any and all temporary structures which are to be used for the
sale of food, preparation of food, and/or eating areas shall be subject
to any and all state and Borough health codes, health certificates,
inspections and fees, and will be subject to any and all requirements
of other food service facilities located within the Borough of Trainer.
All persons, partnerships, firms, companies, corporations or
other entities violating any part of this article shall, upon conviction,
pay a fine, the minimum of which shall be $25 and the maximum of which
shall be $1,000, and/or shall be imprisoned for a period of time not
exceeding 90 days.

No dumpsters, compactors or storage containers shall be placed
upon private property or upon the public streets, sidewalks or other
public areas of the Borough of Trainer unless and until a permit has
been issued pursuant to this article.
Dumpsters, compactors or storage container permits shall provide
approval for the placement of the subject dumpster, compactor or storage
container for a period of 30 days on private property. Dumpsters,
compactors or storage container permits shall provide approval for
the placement of the subject dumpster, compactor or storage container
for a period of no more than seven days upon any public street, sidewalk
or other public area.
Permit renewals shall be permitted in the discretion of the
Building Inspector or Code Enforcement Officer, depending upon the
impact of the dumpster, compactor or storage container upon the neighboring
residents and properties and upon the public health, safety and welfare.
A separate permit shall be required for each and every dumpster,
compactor or storage container.
Permits for the placement of a dumpster, compactor or storage
container upon private property shall require the payment of a permit
fee of $35. Renewal permits for the placement of a dumpster, compactor
or storage container upon private property shall require the payment
of a permit fee of $20. Permits for the placement of a dumpster, compactor
or storage container upon public streets, sidewalks or other public
areas shall require the payment of a permit fee of $125. Renewal permits
for the placement of a dumpster, compactor or storage container upon
public streets, sidewalks or other public areas shall require the
payment of a permit fee of $75.
All applications for permits shall identify the applicant by
name, address and telephone number; shall identify the subject property
by street address; shall state whether the permit is requested for
placement upon private property or upon a public street, sidewalk
or other public area; shall state the requested dates for the placement
of the dumpster, compactor or storage unit; shall identify the item
to be placed by detailed description, including height, width and
length; and shall identify the owner of the property being serviced
by the placement of the dumpster, compactor or storage unit by name,
address and telephone number. If the unit is servicing a tenant of
the property, then the tenant, in addition to the owner, shall be
identified by name, address and telephone number.
The Borough Building Inspector or Code Enforcement Officer shall
consider the impact of the dumpster, compactor or storage unit upon
the neighboring residents and properties and upon the public health,
safety and welfare. Upon such considerations, the Building Inspector
or Code Enforcement Officer shall have the authority to deny the permit,
to grant the permit for an alternate location, and/or to limit the
duration of the permit. Any aggrieved applicant shall have the right
to appeal the decision of the Building Inspector or Code Enforcement
Officer to the Borough Council.
As a condition upon the placement of any dumpster, compactor
or storage container upon any public street, sidewalk or other public
area, the applicant shall provide the Borough of Trainer with a certificate
of insurance, insuring the Borough against any damages to the street,
sidewalk or other public area and insuring the Borough against any
claim of any person or entity for damages or injuries as the result
of the location of the dumpster, compactor or storage container upon
any public street, sidewalk or other public area.
Any person, corporation, partnership, company or other entity
who fails to obtain a permit or who otherwise violates any provision
of this article shall be subject to a fine not exceeding $600.
