Editor's Note: The UCC Administration and Enforcement Regulation adopts the following codes for use throughout the Commonwealth of Pennsylvania: International Building Code; International Residential Code; ICC Electrical Code; International Energy Conservation Code; International Existing Building Code; International Fire Code; International Fuel Gas Code; International Mechanical Code; International Performance Code for Buildings and Facilities; International Plumbing Code; International Urban-Wildland Interface Code. By adopting this ordinance, the Borough considers Ch. 5, Parts 1 through 5, of the 1985 Code superseded by the provisions contained in these international codes.
The Borough of Trainer, Delaware County, hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.101 through 7210.1103, as amended from time to time, and its regulations.
The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 through 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the municipal building code of the Borough of Trainer, Delaware County.

Administration and enforcement of the code within the Borough shall be undertaken in any of the following ways, as determined by the governing body of the Borough from time to time by resolution:
A. 
By the designation of an employee of the Borough to serve as the municipal code official to act on behalf of the Borough;
B. 
By the retention of one or more construction code officials or third-party agencies to act on behalf of the Borough;
C. 
By agreement with one or more other municipalities for the joint administration and enforcement of this Act through an intermunicipal agreement;
D. 
By entering into a contract with another municipality for the administration and enforcement of this Act on behalf of this Borough;
E. 
By entering into an agreement with the Pennsylvania Department of Labor and Industry or approved third-party agency for plan review, inspections and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures.

Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by the code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit.

Residential dwelling work exempt from permit. Permits relating to residential dwellings and/or their accessory structures shall not be required for the following. (Exemption from the permit requirements of this article shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of the code or any other laws or ordinances of this jurisdiction.)
A. 
Building.
(1) 
Painting, papering, tiling, carpeting, cabinets, countertops and similar finish work.
(2) 
Prefabricated swimming pools that are less than 24 inches (610 millimeters) deep.
(3) 
Swings and other playground equipment accessory to a one- or two-family dwelling.
(4) 
Window awnings supported by an exterior wall which do not project more than 54 inches (1,372 millimeters) from the exterior wall and do not require additional support.
B. 
Electrical. Repairs and maintenance. A permit shall not be required for minor repair work, including the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles.
C. 
Gas.
(1) 
Portable heating, cooking or clothes' drying appliances.
(2) 
Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.
(3) 
Portable fuel cell appliances that are not connected to a fixed piping system and are not interconnected to a power grid.
D. 
Mechanical.
(1) 
Portable heating appliances.
(2) 
Portable ventilation appliances.
(3) 
Portable cooling units.
(4) 
Steam, hot or chilled water piping within any heating or cooling equipment regulated by the code.
(5) 
Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.
(6) 
Portable evaporative coolers.
(7) 
Self-contained refrigeration systems containing 10 pounds (4.54 kilograms) or less of refrigerant or that are actuated by motors of one horsepower (746 watts) or less

Fees assessable by the Borough of Trainer for the administration and enforcement undertaken pursuant to this article and the code shall be established by the Trainer Borough Council by resolution from time to time.
A Board of Appeals shall be established by resolution of the governing body of Trainer Borough in conformity with the requirements of the relevant provisions of the code, as amended from time to time, and for the purposes set forth therein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, said Board of Appeals shall be established by joint action of the participating municipalities.
A. 
Building code ordinances which were adopted by the Borough of Trainer, Delaware County, on or before July 1, 1999, and which equal or exceed the requirements of the code shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the code, as amended from time to time.
B. 
All building code ordinances or portions of ordinances which are in effect as of the effective date of this article and whose requirements are less than the minimum requirements of the code are hereby amended to conform with the comparable provisions of the code.
C. 
All relevant ordinances, regulations and policies of the Borough of Trainer, Delaware County, not governed by the code shall remain in full force and effect.
