There is hereby established a Joint Fire District in the Town of Little Valley and the Village of Little Valley, to be known as the "Little Valley Joint Fire District," the boundaries of which shall be coterminous with the boundaries of the Town and shall include all real property situate in the Village.
In all respects, the provisions of Article 11 of the Town Law, not inconsistent with the provisions of this chapter, shall apply to the establishment, operation and management of the Joint Fire District hereby created.
The property and affairs of the Little Valley Joint Fire District shall be under the management and control of the Board of five Fire Commissioners who shall be selected in the manner provided by Article 11 of the Town Law.
Such Fire Commissioners shall receive no compensation for their services, but they and their employees shall be allowed and paid their necessary expenses, payable as expenses of the District.
This chapter shall not take effect until 30 days after its adoption, nor until approved by the affirmative vote of a majority of the qualified electors of the Joint Fire District hereby created, voting on such propositions, if within 30 days after its adoption there be filed with the Town Clerk of the Town or the Village Clerk of the Village a petition subscribed and acknowledged by electors of the Joint Fire District qualified to vote upon a proposition to raise and expend money, in number equal to at least 5% of the total vote cast for governor in the Town of Little Valley, including the Village of Little Valley, at the last general election held for the election of state officers, but which shall not be less than 25 persons, protesting against such chapter and requesting that it be submitted to the qualified voters of the Joint Fire District for their approval or disapproval. The petition may be made upon separate sheets and the signatures to each sheet shall be authenticated in the manner provided by the Election Law of the State of New York for the authentication of nominating petitions. The several sheets, so signed and authenticated, when fastened together and offered for filing shall be deemed to constitute one petition. If, within five days after the filing of such petition, a written objection thereto be filed with the Town Clerk of the Town or the Village Clerk of the Village, a verified petition setting forth the objections must be presented by the person so filling such objections to the Supreme Court or any justice thereof of the judicial district in which the Joint Fire District is located.
The Town Clerk of the Town shall post and publish a notice which shall set forth the date of the adoption of this chapter, shall contain an abstract of such chapter concisely setting forth the purpose and effect thereof, shall specify that such chapter was adopted by the Town Board of the Town and the Board of Trustees of the Village subject to a permissive referendum; and shall publish such notice in the Chronicle, a newspaper published in Cattaraugus County having a general circulation in the Joint Fire District hereby created, and said Clerk shall further post or cause to be posted on the sign board of the Town and on the sign board of the Village a copy of such notice within 10 days after the adoption thereof.
The Town Clerk of the Town shall, within 10 days from the date hereof, cause a certified copy of this chapter to be filed in the New York State Department of Audit and Control and, within such period of 10 days, shall cause a certified copy of such chapter to be recorded in the office of the County Clerk of the County of Cattaraugus.
