Pursuant to § 24-0501 of Article 24 of the Environmental
Conservation Law, in relation to the regulation, management, protection
and conservation of the freshwater wetlands within the Town of Lowville,
the Town of Lowville hereby adopts and sets forth, as this chapter
for freshwater wetlands protection, the provisions of such Article
24, including the procedures and concepts contained therein, as such
law may from time to time be amended, except that the provisions of
such Article 24 to the extent authorized shall be administered by
the Town of Lowville as provided herein.
Furthermore, after issuance of the official Freshwater Wetlands
Map for the Town of Lowville or any portion thereof, pursuant to § 24-0301
of said Article, any person desiring to conduct on freshwater wetlands,
as so designated in such map and any amendments thereto, any of the
regulated activities set forth in § 24-0701, Subdivision
2, of said Article must obtain a permit from the Town Clerk of the
Town of Lowville.
In granting or denying the permit the Town Clerk shall be guided
by the provisions of § 24-0705. Any appeals from the decision
of the Town Clerk shall be taken in accordance with the provisions
of § 24-1103 of said Article.
Pursuant to § 24-0701, Subdivision 4, a permit shall
not be required for use of land for agricultural pursuits except for
certain construction of buildings and other activities not in the
natural course of agribusiness as set forth in this section.
There shall be no fee for the applying for or granting of a
permit, but the penalties set forth in said Article for a violation
thereof constitute a civil penalty as provided in § 71-2303
of said Article.
