The parks and recreation area referred to herein in the Township
are those parks and recreation areas situated on land owned by or
under the jurisdiction of the Township.

The park and recreation areas shall be closed from dusk until
sunrise except for areas designated by the Township Manager and posted
under the authority of the Township Manager, which areas may remain
open until 10:00 p.m., prevailing time.
Licensed vehicle operators shall use only roads and parking
areas open to public vehicular traffic, unless otherwise directed
by the police of the Township of Fairview.
The operation of nonlicensed motorized vehicles is not permitted
on park or recreation area roads, parking areas and trail unless specifically
designated.

The following are prohibited within the parks and recreation
areas:
A. Any disorderly or immoral acts.
B. Throwing stones or missiles.
C. Uttering loud, profane, offensive or indecent language.
E. Pets, except for Seeing Eye dogs.
G. Throwing, depositing or draining any offensive substance of any kind
or depositing paper, fruit, food, refuse, lunch containers or other
refuse in any places except in receptacles provided therefor.
H. Depositing materials other than materials accumulated during use
of the parks and recreation areas.
I. Building open fires in other than facilities provided therefor.
J. Disposing of hot coals from charcoal grills in other than facilities
provided therefor.
L. Sleeping on the ground or elsewhere, except in such places and at
such times as may be designated by the Township Manager or Recreation
Commission.
M. Drinking any alcoholic beverages.
N. Parking of motor vehicles during hours when the parks and recreation
areas are closed.

A. The following acts are prohibited within the parks and recreation
areas unless prior approval is obtained in writing from the Township
Supervisors:
(1) Pulling, injuring, breaking or digging up any flower, fruit, plant,
tree, grass or turf.
(2) Breaking or defacing any pump, bench, water fixture, structure or
equipment.
(3) Possessing or discharging any firearms, air rifles, air pistols,
sling shots, archery equipment or fireworks.
(4) Carrying an ax, saw, pick, shovel or spade within any park or recreation
area.
(5) Offering anything for sale.
(6) Obstructing in any way any roadway, parking area, trail or path.
(7) Posting or displaying any banner, sign or advertisement of a commercial
or political nature.
(8) Killing, maiming, injuring or destroying any wildlife.
(9) Unorganized or organized instruction, exhibition, demonstration or
special camping events.

Consumption of alcoholic beverages the alcoholic content of
which does not exceed 7%.
B. Written approval for the consumption of alcoholic beverages shall
be granted only to a nonprofit organization whose organized purpose
is to provide a community-wide service and which is providing same.
In determining whether to approve an application for the consumption
of alcoholic beverages as defined above, the Township shall require
that the applicant produce a license from the Liquor Control Board
permitting the applicant to dispense alcoholic beverages. Said written
approval shall state the date or dates and the hours during which
alcoholic beverages may be consumed or dispensed. No application shall
be approved if the event at which the alcoholic beverages are to be
consumed is one which may adversely affect the health, safety and
welfare of the residents and the maintenance of the park. The applicant
shall comply with all applicable laws, rules and regulations and shall
indemnify and save harmless the Township from any cost, expense or
liability (including the defense of same) in a manner satisfactory
to the Township. The Township may require a fee to reimburse it for
any expenses it may have in connection with any event for which it
grants approval for the consumption of alcoholic beverages.
Organized competition, such as baseball and football, must be
scheduled through the Recreation Commission.

Any firm, person or corporation found to be in violation of
any provision of this chapter shall pay a fine of not more than $600.
Any police officer or other person specifically authorized by the
Board of Supervisors of Fairview Township shall determine in each
instance whether a violation has occurred under this chapter. Upon
determination that a violation has occurred, the officer or other
person designed by the Board of Supervisors shall impose a fine upon
the violator and shall give the violator written notice by United
States mail or in person of the violation and the imposition of the
fine. If the violator fails to pay the fine within the time specified
in the notice of violation, the police officer or other authorized
person may institute a civil enforcement proceeding on behalf of the
Township and any person, firm or corporation found to be in violation
shall pay the fine as set forth above, plus all court costs and reasonable
attorney's fees incurred by the Township in the civil enforcement
proceeding. Each day that a violation of this chapter continues shall
constitute a separate offense.
