No persons shall conduct, operate, sponsor, or permit any show, exhibition, pony ride or any mechanical device of any kind whatsoever on which children or others may visit or ride for amusement without first having obtained a license for such activity.

The license fee for the operation of each pony ride, show, exhibition, or amusement riding device of any kind shall be one dollar ($1.00) per day.

No license required by Section 640.010 shall be issued until such time as the owner or operator of any such pony ride or amusement riding device shall produce a policy of insurance which protects the public for personal liability for bodily injury in a minimum amount of one hundred thousand dollars ($100,000.00) for each person, and three hundred thousand dollars ($300,000.00) for each occurrence, and personal liability for property damage in the amount of fifty thousand dollars ($50,000.00) for each occurrence.

A deposit of one hundred dollars ($100.00) shall be deposited with the Collector to insure that City property is not damaged or destroyed and that the general area used for and surrounding the show, exhibition, pony ride or other amusement riding device is clean and free of litter when the owner or operator departs from the premises. Any cost of repair, replacement or cleanup shall first be deducted from the deposit and the balance, if any, shall be refunded to the depositor.

All such licenses shall specify the character and nature of the activity licensed and the place, time and dates at which it will be conducted.

Any license granted under this Chapter may be revoked by the Board of Aldermen upon twenty-four (24) hours' notice which may be either delivered to the owner, operator, or person in charge of the show, exhibition, pony ride or other amusement riding device, or to the sponsor, personally, or sent by United States mail to the address recited in the application for a license. If the license is revoked without cause, the proportionate amount of the license fee for the unexpired portion of the license term shall be refunded. If the license is revoked for any violation of the Municipal Code of the City of Northwoods, or any City ordinance, State Statute or Federal law, no portion of the license fee shall be refunded.

In the event a condition exists which endangers the public health, safety, morals, welfare, peace or tranquility of the community, the Mayor, Chief of Police or the highest ranking officer in the Police Department is empowered to declare such condition to be an emergency condition, and he/she may order the owner, operator or person in charge of the show, exhibition, pony ride or other amusement riding device to cease operations immediately and to take whatever action is necessary to enforce said order. If an emergency condition is declared to exist, the person declaring the emergency condition shall make a report of all facts and circumstances involved in the emergency condition to the Board of Aldermen as soon thereafter as is reasonably possible.

Any show or exhibition conducted wholly for religious, educational, benevolent or charitable purposes and not for private gain shall be exempted from payment of the license fee required by this Article.

Any person, firm or corporation violating any provisions of this Chapter shall, for each offense, be fined not more than one hundred dollars ($100.00) or a Jail sentence not to exceed ninety (90) days, or both such fine and Jail time. Each day's violation or failure, refusal or neglect to comply with any provision of this Chapter shall constitute a separate and distinct offense.
